On May 29, 2025, the Minister of Municipal Affairs and Housing filed Ontario Regulation (O. Reg.) 80/25. The Ministry of Health requested that the Minister consider making the Zoning Order.
Decision details
A Zoning Order, made pursuant to clause 47(1) of the Planning Act, regulates the use of the land and the erection, location and use of any building or structure on the land. The Minister’s Zoning Order was made at the request of the Minister of Health.
Pursuant to clause 47(8) of the Planning Act, O. Reg. 80/25 amends O. Reg. 10/24 by amending section 5 that requires the order to be revoked on May 30, 2025. The effect of O. Reg. 80/25 is that O. Reg. 10/24 will remain in effect until May 29, 2026.
O. Reg. 80/25 does not address the requests to amend Map Nos. 345 and 346 to O. Reg. 10/24 outlined in ERO notice 025-0348, nor any other requests for site-specific amendments to O. Reg 10/24 received in response to this ERO notice or otherwise submitted to the Ministry. There will be a separate and subsequent review process and Minister’s decision on any such requests to amend the text and/or mapping of O. Reg. 10/24.

Reg. 10/24, as amended, protects public health and safety by regulating building heights to ensure the safe operation of air ambulance services provided in relation to St. Michael's Hospital and The Hospital for Sick Children. The zoning order prohibits any building, structure or naturally growing object from penetrating into the obstacle limitation surfaces for the St. Michael's Hospital Heliport and The Hospital for Sick Children Heliport, subject to the exceptions listed in the order.
Effects of consultation
All comments received were taken into consideration prior to a decision being made.
- Members of the public voiced support for making the MZO permanent, noting that public safety and health care should take precedence over development, and that flight paths should be protected.
- The hospitals request that the MZO become permanent, with the removal of the revocation clause, to ensure that building heights do not impact Ornge Air Ambulance flight operations into the hospitals.
- Transport Canada supports making the MZO permanent as the ongoing validity of the MZO supports the Province’s commitment to protecting the long term viability of the vital services.
- Landowners/builders with lands subject to the MZO generally objected to the proposed amendment to the MZO, with some seeking to have an alternative approach implemented for the flight paths that would facilitate their proposed developments.

Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Although not required, the ministry is providing public notice of this request for consultation.
Proposal details
A Minister’s Zoning Order (MZO), made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
Ontario Regulation (O. Reg.) 10/24 protects public health and safety by regulating building heights to ensure the safe operation of air ambulance services provided in relation to St. Michael's Hospital and The Hospital for Sick Children. The zoning order prohibits any building, structure or naturally growing object from penetrating into the obstacle limitation surfaces for the St. Michael's Hospital Heliport and The Hospital for Sick Children Heliport, subject to the exceptions listed in the order.
O. Reg. 10/24 applies to those lands subject to the obstacle limitation surfaces for the St. Michael's Hospital Heliport and those lands subject to the obstacle limitation surfaces for The Hospital for Sick Children Heliport, as shown on the existing maps referenced in the regulation, identified below.
The Minister is considering a request from the Minister of Health to amend Ontario Regulation 10/24. If made, the amendment to the MZO would:
- Remove section 5 of the order that requires that O. Reg. 10/24 be revoked on May 30, 2025
This amendment request is related to ERO proposal 025-0348 in respect of requests for site-specific amendments and minor technical amendments to Map Nos. 345 and 346 that form part of O. Reg. 10/24.
To help ensure decisions are made in a transparent manner and support government priorities, the Ministry is seeking feedback on whether this request should be considered and any additional information that may help inform a decision. This consultation is limited in scope to the proposed removal of the expiry date, and submissions related to further amendments to the MZO will need to be submitted per the ministry’s Zoning Order Framework.
