Decision summary
On May 28, 2026, the Minister of Municipal Affairs and Housing filed Ontario Regulation (O. Reg.) 161/26. The Minister of Health requested that the Minister consider making the Zoning Order. A request by the owner of property at 595 Bay St., 304-316 Yonge St., 14-80 Dundas St. W. to amend Map No. 345 to O. Reg. 10/24 has been refused.
Decision details
A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of the land and the erection, location and use of any building or structure on the land. The Minister’s Zoning Order was made at the request of the Minister of Health to amend Ontario Regulation 10/24. O. Reg. 10/24 protects public health and safety by regulating building heights to ensure the safe operation of air ambulance services provided in relation to St. Michael's Hospital and The Hospital for Sick Children. The zoning order prohibits any building, structure or naturally growing object from penetrating into the obstacle limitation surfaces for the St. Michael's Hospital Heliport and The Hospital for Sick Children Heliport, subject to the exceptions listed in the order. O. Reg. 10/24 applies to those lands subject to the obstacle limitation surfaces for the St. Michael's Hospital Heliport and those lands subject to the obstacle limitation surfaces for The Hospital for Sick Children Heliport, as shown on the existing maps referenced in the regulation.
Ontario Regulation 161/26 amends O. Reg. 10/24 in the following ways:
- It deletes sections 5 and 6 removing the requirement that the order be revoked on May 29, 2026, thereby ensuring the long-term protection of the flight paths,
- It makes several minor technical changes related to reference points, terminology, labels, tables and small map adjustments resulting in the order now referencing two new updated maps forming part of the regulation.
The Minister is also refusing an application to amend Ontario Regulation 10/24 by the owner of property at 595 Bay St., 304-316 Yonge St., 14-80 Dundas St. W. to amend Map No. 345. No decision has been made in respect of an application to amend Ontario Regulation 10/24 by the owner of property at 15-17 Elm St.
Effects of consultation
All comments received were taken into consideration prior to a decision being made.
The proposal received comments from the public and the aeronautical consultants on behalf of the hospitals.
- A member of the public noted it was not appropriate for the property at 15-17 Elm Street to be exempt from flight path
- Avia NG on behalf of St. Michael's Hospital and The Hospital for Sick Children, were not supportive of the amendment requests of the owners of 15-17 Elm Street and 595 Bay St., 304-316 Yonge St., 14-80 Dundas St. West, based on their review of the amendment requests.
Following the consultation period, Transport Canada indicated to the Minister that it did not support amendments that would reduce or compromise the existing level of protection afforded by Ontario Regulation 10/24.

Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Although not required, the ministry is providing public notice of this request for consultation.
Proposal details
A Minister’s Zoning Order (MZO), made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
Ontario Regulation (O. The Minister is considering requests from the following landowners to make site-specific amendments to Map No. 345 that forms part of O. Reg. 10/24:
- 15-17 Elm Street
- 595 Bay Street, 304-316 Yonge Street, 14-80 Dundas Street West (Atrium on Bay)
The Minister is also considering requests to amend O. Reg. 10/24 to incorporate a number of minor technical changes relating to reference points, terminology, labels, tables, and small minor map adjustments to Map Nos. 345 and 346 that form part of the regulation.
This amendment request is related to ERO proposal 025-0347 in respect of a request to remove the expiry date for O. Reg. 10/24.
To help ensure decisions are made in a transparent manner and support government priorities, the Ministry is seeking feedback on whether this request should be considered and any additional information that may help inform a decision. This consultation is limited in scope to the specific requests noted above, and submissions related to further amendments to the MZO will need to be submitted per the ministry’s Zoning Order Framework.
