This notice is given in accordance with section 47 of the Environmental Bill of Rights, 1993 and is based on information provided by the appellant in their notice of appeal. Description of decision

On March 4, 2026, the Director issued an order under the Environmental Protection Act requiring the removal of waste stockpiled at 2026 Campbell Avenue, Cavan-Monaghan, and an assessment of whether the waste is causing any adverse effects on any of the seven adjacent neighboring residential properties.

Grounds for appeal

The Appellant is appealing Director’s Order No.1-1489998844. The appellants claim that:

• It did not own, manage, control, or occupy the lands or waste identified in the Order;
• It did not cause, permit, or arrange for the deposit of waste at the site;
• There is insufficient evidence connecting it to the alleged waste disposal activities; and
• The Director lacked a sufficient factual and legal basis to issue the Order against it.

• they did not cause, contribute to, or have knowledge of the waste disposal activities;
• responsibility for waste removal should rest with those responsible for the disposal or concealment of the waste;
• the Order unfairly allocates responsibility among affected property owners;
• the contingent liability imposed by Work Order Items 3 and 4 is unreasonable;
• they were not given an opportunity to comment on Work Order Items 3 and 4 before the final Order was issued; and
• Work Order Items 3 and 4 should be removed from the Order.
