A decision was made on March 16, 2026, to approve, without modifications, the Town of Whitby Official Plan Amendment 139 as adopted by By-law 8149-25, in accordance with section 26 of the Planning Act. Notice of this decision was issued on March 16, 2026, to the Town of Whitby.
The adopted Town of Whitby Official Plan Amendment 139 was reviewed for consistency and conformity with applicable provincial plans and policies, and regard for matters of provincial interest set out in the Planning Act.
Official Plan Amendment 139 implements the policies of the Provincial Planning Statement, 2024. The Town of Whitby Official Plan Amendment 139 proposes amendments across a number of the policy themes/sections, including intensification policies within Strategic Growth Areas
Official Plan Amendment 139 is consistent with the policies of the Provincial Planning Statement, 2024 and complies with applicable legislation. No modifications are required by the Minister.
Pursuant to subsections 17 (36.5) and (38.1) of the Planning Act, this decision is final and not subject to appeal. Accordingly, Town of Whitby Official Plan Amendment 139, as approved by the Minister, came into effect on March 16, 2026.
Effects of consultation
As a result of public consultation on Official Plan Amendment 139, the Ministry received a total of 3 comments through the Environmental Registry of Ontario.
Two (2) included letters requesting that certain site-specific lands be included in the Strategic Growth Area boundaries, and one (1) expressed support for the approval of Official Plan Amendment 139.
All comments reviewed were taken into consideration, prior to a decision being made.

Proposal details
The Ministry of Municipal Affairs and Housing is in receipt of the Town of Whitby’s Official Plan Amendment (OPA) No. 139 for a decision, which was adopted by the Town of Whitby’s Council on February 3, 2025, pursuant to sections 17 and 26 of the Planning Act by By-law 8149-25.
The More Homes Built Faster Act, 2022 (Bill 23) made changes that removed statutory powers under the Planning Act from seven upper-tier municipalities identified in the legislation. The effective date for Durham Region was January 1, 2025. As such, the Minister of Municipal Affairs and Housing is now the approval authority for official plans and official plan amendments for lower-tier municipalities in Durham Region.
The Ministry will review the matter for consistency and conformity with applicable provincial land use policies and plans and will consider all feedback received before presenting any potential modifications to the Minister of Municipal Affairs and Housing for a decision in accordance with section 17 of the Planning Act.
The proposed OPA No. 139 contains detailed land use policies to support implementation of various Strategic Growth Areas in the Town.
If approved, proposed OPA No. 139 will apply to the following areas:
Dundas Street Rapid Transit Corridor, as shown on Schedule D of OPA No.139;
Brock/Taunton Major Urban Central Area;
Dundas East Urban Central Area;
Rossland/Garden Urban Central Area;
and select sections of Intensification Corridors, as shown on Schedule B of OPA No.139.
