Proposal summary

The Ministry of Municipal Affairs and Housing has received a request to make a Minister's Zoning Order for lands in the Nanticoke Area of Haldimand County to facilitate a mixed- use development. The Ministry is seeking input on whether this request should be considered and any additional information that may help guide the Minister's decision.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act. Although not required, the ministry is providing public notice of this request for consultation.

Proposal details

The Ministry of Municipal Affairs and Housing is consulting on a request for a
Minister’s Zoning Order (MZO) submitted by Empire Communities, supported by resolutions of Haldimand County Council passed on March 7, 2022; May 29, 2023; and June 24, 2024, to facilitate a mixed‑use community on lands located in the Nanticoke area of Haldimand County.

An MZO, made pursuant to section 47 of the Planning Act, regulates the use of
land and the erection, location, and use of buildings or structures, and prevails over the existing municipal zoning by‑law to the extent of any conflict.

The requested MZO seeks to permit a range of industrial, commercial,
institutional, and residential uses on approximately 1,700 hectares of land in the Nanticoke area of Haldimand County (see location map below). Informed by this consultation, the configuration and type of proposed land uses depicted on the map may be refined as the proposal is further developed.

The majority of the subject lands are currently designated for industrial andagricultural uses in the Haldimand County Official Plan.

To help ensure decisions are made in a transparent manner and align with government priorities, the Ministry is seeking public and stakeholder feedback on whether this MZO request should be considered, including any additional information that may assist in informing a decision. This includes feedback related to potential land use compatibility issues, environmental considerations, health and safety considerations, servicing and infrastructure considerations, economic effects on the community, financial impacts on the municipality, and implications for existing or approved development, as well as potential mitigation measures.
