Why consultation isn't required
The Ministry is posting this notice of exception pursuant to subsection 30(1) of the Environmental Bill of Rights, 1993 (EBR), as the environmentally significant aspects of this decision have already been considered through a process of public participation under the EBR that was substantially equivalent to the process required in relation to this proposal.
The redesignation of these lands was proposed as part of City of Toronto Official Plan Amendment No. 804 (OPA 804), which was posted for public consultation on the Environmental Registry of Ontario for 45 days, from June 24, 2025, to August 8, 2025 (ERO #025-0702).
The Ministry received 86 comments, including comments specifically addressing the proposed redesignation of these sites and the associated study and policy requirements.
Exception details
On September 24, 2026, the Minister of Municipal Affairs and Housing issued an order under section 23 of the Planning Act to amend the City of Toronto's Official Plan. The order redesignates certain areas in four locations, namely:
- Lands within the ConsumersNext, Don Mills Crossing, and Don Mills Secondary Plan areas from General Employment to Mixed Use Areas
- Lands within the Downsview Secondary Plan area, and a portion of the Don Mills area from General Employment to Institutional Areas.
The specific lands affected and changes to them are set out in the order and its schedules.
This order addresses only the lands identified in the order. It does not approve, refuse, or otherwise determine the status of the remainder of OPA 804, which remains before the Ontario Land Tribunal for its review. More information regarding OPA 804 can be found at this link.
Environmental considerations
This decision changes the land use designation of the identified lands. It does not itself authorize any physical development, construction, or site alteration. Future development on these lands will remain subject to applicable municipal approvals — including zoning by-law amendments, site plan control and other Planning Act processes as applicable — through which site-specific environmental matters will continue to be reviewed.
