It seems entirely inappropriate for the property at 15-17 Elm St to be exempt from this critical flight path just because they have submitted an application in to construct a tower on this site. This application has NOT been approved by City Council, does not comply with Provincial planning policy and is presently actively under appeal to the Ontario Land Tribunal. Any decision to make an amendment on this flight path would be premature and set a dangerous precedent of chiseling away and encroaching into a protected flight path that is critical to Toronto and Ontario's healthcare needs. Approving this site specific amendment would suggest any property owner who wishes to build a tower on their site, but is inconvenienced by the flight path, could simply circumvent the Planning process that has been established in Ontario.
