I prefer the Manitoba legislation where administration has the ability to approve variances of up to 15% for any minimum or maximum requirement in the zoning bylaw without notice or a public hearing. This eliminates frivolous public hearings but municipalities retain the ability to refuse an application if circumstance warrant it. If administration is inclined to refuse the proposed variance, the applicant can elect to proceed through the regular variance process and receive a decision from Council.
