Please do not remove Section 37. It has been a very important mechanism for achieving WIN-WIN situations, whereby both developers and citizens come to fruitful compromises.

Capping community benefit charges based on the appraised value of the land leaves out the larger social and geographic context of the piece of land. For example, the property in question may be the community's last chance for trees or green space, all others having been eradicated in earlier development proposals that everyone -- including the current proponent -- now regards as flawed.
Section 37 allowed for flexibility.
An arbitrary cap on community benefit charges would sentence to community to more bad development.
It will harm developers in the long run, by discouraging them from making their proposals the best they could be.
It will create future slums.
