In reviewing the latest noise assessment, a few items have been identified that are a concern to the overall application and are detailed below.

Latest ERO submission challenges the requirement for an EAA, the proponents
ECA application states that this is a new ECA application, but claims to want to change ECA 4568-AJTR84 - dated Jan 8/19. (Attached)

ECA 4568-AJTR84 is an approval for a 1.72 hectare waste disposal site, while the current ECA application is requesting approval for almost double to a 3.24 hectare site (as defined in the ECA application, however the ERO website states a 3.4 hectare site - it is unclear which is correct).

The current ECA application states the application is exempted from requirements of the EAA (Environmental Assessment Act) stating regulation 101/07 section 17s, however regulation 101/07 section 18s should apply. Specifically the site is almost doubled and the amount of waste being received is increasing to almost 2500 tonnes per day from an approved 1500 tonnes in ECA 4568-AJTR84. Additionally, the proposal is wanting to increase the amount of residual waste from the site per day from 545 tonnes to 560 m3 of liquid waste and 248 tonnes of solid waste.

We conclude that the ECA application is incorrect should NOT be exempted from EAA requirements.

Other issues with the application, it states the site is zoned as heavy industrial, however only half the 3.24 (or 3.4) hectares are designated that, about half is just zoned industrial.

There was no correspondence , (and it has been confirmed by the proponent) that documentation from the City of Toronto was NOT included to confirm the current zoning permits the proposed use.
