The portion of the amendment to the planning act pertaining to site plans leaves open the question of what effect the residential exemption will have on residential properties already subject to a registered site plan agreement.
In these instances does the property owner have the ability to contravene the existing agreement to add another dwelling? Does the existing agreement prevail to restrict the use of the property to what is shown on the exiting site plan?
In the case of an existing site plan the has been placed on a property with only a single residence and there is a proposal to add another structure (eg a garage) can an amendment to the existing site plan be required.
The legislation has failed to take into account properties where a single residential dwelling has been subject to required site plan.
This is common in the many municipalities in the District of Muskoka.
