It is imperative that the new Perth County Official Plan is 100% legally correct before it is approved by the Minister. I sent the two emails below to the County to correct their error on the attached Schedule B Map BEFORE the County Adopted the Official Plan on October 17, 2024, through By-law 4003-2024 and submitted it for Final Approval by the Minister.
On September 27, 2024 I wrote:
Just got a notice the final draft of the official plan is ready and I checked it out online. Please see attached. This one strip has to be green open space. It's legally part of Block 69 of Plan 44M-45 and it's zoned open space in the Plan of Subdivision. It's the drainage channel leading to the massive pond on my site (block 69) that I dug in 2009. Want to make sure this little strip isn't approved as purple Industrial because it is not and has to be green open space
Then on October 8, 2024 I wrote:
Thanks for the response. Attached is an Easement that I transferred to the Municipality in 2009 and the pond and drainage channel Plan. This is registered on the land separate from Plan 44M-45. The drainage channel can never be Industrial land and will always be open space. There is no physical connection between my Industrial land and .......... Industrial to the East. My Industrial is separated from his Industrial by this drainage channel. This strip has to be shown as green open space in the Final plan to differentiate the 2 lands to show there is no physical connection between our 2 Industrial lands (Non-contiguous). I understand you may have some printed material showing this strip purple and it doesn't make sense to correct it now but on the final plan it has to be shown as green to match this legal easement that I gave the Municipality.
Despite my sending these two emails and including the attached two files BEFORE the Official Plan was adopted by the County on October 17, 2024, through By-law 4003-2024, my emails and attachments were disregarded, and the plan was adopted with a legal error.
All they had to do at the time was do a revision on the plan
To be clear, Blocks 68 and 69 of Plan 44M-45 have to be 100% legally correct before this plan is approved. This plan should NOT be approved by the Minister until the attached legal Easement has been included and Schedule B has been updated to include this Legal Easement
