By repealing the Endangered Species Act and replacing it with the weaker Species Conservation Act, the bill diminishes safeguards for at-risk species and their habitats. It narrows the definition of “habitat” to immediate nesting areas, excluding essential foraging and migratory spaces, thereby leaving species vulnerable to habitat destruction .
Furthermore, the bill introduces a “registration-first” approach, allowing developers to proceed with projects that may harm species without prior environmental assessments or permits. This shift undermines scientific oversight and public consultation, placing economic interests above ecological and community well-being.
The creation of “Special Economic Zones” under Bill 5 permits the provincial cabinet to exempt certain areas from environmental regulations and municipal bylaws, effectively sidelining democratic processes and Indigenous rights.
