I have some questions regarding the proposed MOECC excess soil regulations "Proposed Excess Soil Regulatory Package – New Proposed Regulation and Amendments to Existing Regulations"):

Pg. 14– QPs and ESMP Please provide clarification on what constitutes a direct or indirect conflict of interest. One impression is that if the employee of the proponent is not a shareholder of the company, it would not be considered a conflict of interest. Please comment. Pg. 14 – Definition of a Qualified Person (QP) Why can’t individuals who are registered and certified through the Ontario Association of Certified Engineering Technicians and Technologist (OACETT) and have professional liability insurance, be considered QPs? Pg. 34 – Naturally elevated concentrations of substances How will naturally elevated concentrations of substances be determined/defined? Will there be an online database of publically available analytical records and reports so that comparisons/statistical analysis can be made? Will a province-wide report of naturally elevated concentrations of substances such as Barium, be created and made publically available?
