Under their current license, Miller's Boyington #3 pit was to be rehabilitated where extraction is exhausted or by October 30th, 2015. After failing to comply with this deadline, Miller now wants to transform part of the property into an industrial site. Will there be any kind of impact assessment, environmental or otherwise, for the proponent's current proposal?
The current application may not be in compliance with O. Reg. 140/02, s. 40 (2), under the Oak Ridges Moraine Conservation Act, 2001, S.O. 2001, c. 31:
"An application for a small-scale commercial, industrial or institutional use with respect to land in a Countryside Area shall not be approved unless the applicant demonstrates that the buildings and structures will be planned, designed and constructed so as not to adversely affect,
(i) the rural character of the Countryside Areas, and
(ii) the ecological integrity of the Plan Area. O. Reg. 140/02, s. 40 (2)."
The Act specifies that ecological integrity includes hydrological integrity, and the proposed site is in an area of highly vulnerable aquifer.
