Based on the terms of the Oak ridges Moraine Plan and Act, MNRF must reject the subject application outright and enforce the terms of license. MNRF must demand and put in place a meaningful timetable whereby the license holder must remove all materials and vehicles currently located in the outdoor storage yard. Further importation of any fill material must be stopped immediately. MNRF must also insist that the license holder initiate a meaningful ongoing progressive site rehabilitation program. Failure by the license holder to undertake either one or all of these requirements should be subject to legal action and/or revocation of the license for the Miller Boyington Pit #3. Should the license be revoked, rehabilitation of the pit should then be undertaken under the supervision of MNRF with funding to be provided by the current license holder. It is time for MNRF to start meeting its obligations with respect to enforcing the Oak Ridges Moraine Conservation Plan and Act on the Miller Boyington Pit #3 property.
