Under the terms of the application the licensee is wishing to change the use of the Miller Boyington Pit #3 property to include the construction of a large (10,000 sq. ft.) building and approval for a large equipment storage yard. Operations at the pit fall under the Aggregate Resources Act, an Act that identifies what can and cannot be done on aggregate pit lands. Operations at the Miller Boyington Pit #3 also fall under the purview of the Oak Ridges Moraine Plan and Act which, as of November 15, 2001 prohibits new uses and expanded existing uses on lands located within the boundaries of the Act. Since neither the large building nor the large equipment storage yard were included in the original Miller Boyington Pit #3 license, these two proposed uses must be regarded as “New Uses”, and as such should be denied outright by MNRF during the review process. Although past events would indicate MNRF has chosen not to enforce the terms of the license, it is time for MNRF to live up to its mandated responsibilities and deny the current application.
