Zelinka Priamo Ltd. represents John Aarts Group (JAG) with respect to the Haldimand County Official Plan Review. JAG owns the property municipally known as 4691 Highway 6.
The Municipal OPA would have the effect of redesignating the entirety of the subject lands from Agriculture to Rural Industrial, as identified on Schedule ‘A.6’ Rural Industrial.
Meanwhile, JAG has submitted applications to redesignate and rezone the subject lands for industrial and commercial development.
Our key comments relate to:
1. That the permitted uses list (Policy 4.C.4)2), if intended to be exhaustive, is limiting of industrial development, and not consistent with the historical development of the area; and
2. That designation of the easterly portion of the lands as Rural Industrial would preclude the development of the lands for commercial uses as is intended by the applicant (as per the new Provincial policies on Employment Lands).
We request that the Minister:
1. Clarify that the list of permitted uses in the Rural Industrial designation is not exhaustive.
2. Remove the portion of land proposed for commercial uses from the Rural Industrial designation, as such uses would not be permitted in Employment Lands under new provincial policy framework, or implement the applicant requested site specific policy. Alternatively, the Minister could directly implement a site specific policy in Section 9C of the Municipal OPA to implement the already-in-progress applications.
