I realize this ERO commentary is for the sewage spreading zone, but the two original ECAs for the storage site and the spreading zone over lap so much I will make my concerns on both together. Also, as there does not seem to be a renewal for the storage site ECA.
As an adjoining landowner to the site at 145003 Hilliardton Road, I have seen the MOE staff disregard many Ontario environmental regulations, and did not do their due diligence when presented with points of risk to the environment from myself for two and half years.
I have watched the operators of the site disregard or ignore many stipulations in the original ECA 7047-C5YKLU terms and conditions.
November 12, 2021.
-My first knowledge of this site being a sewage lagoon was driving by the site, and the operator was pumping water from the lagoon emptying it into the field and road ditch.
-I immediately went to the Township of Armstrong office to seek information whether this was a licensed waste site?
-The Armstrong Township did not know anything about it, as the MOE never informed the municipality of a licensed waste site.
-My wife phoned the MOE Spill Hotline, to see if this was a licensed waste site or if it was an illegal spill.
The MOE staff could not find the site address, nor could they answer any of our concerns.
-The following week, MOE staff contacted my wife that it was a licensed site, and would forward documents to us by email to the Armstrong Township office.
-November 18, 2021 the documents are emailed to the township and the clerk printed them for us.
-The clerk informed me that she saw an appeal was still open on the approval of this site until November 20, 2021. Two days.
-Under ERO 019-3990
-November 19. 2021, I emailed my concerns to the Minister of the Environment's office, Seeking Leave to Appeal. November 20, 2021 was a Saturday so I had to rush my appeal in by Friday, I assumed.
-November 19, 2021 the Minister's Office (name with held) informed me by email that my appeal was made in time by confirmation email.
-I sent two hard copies of my appeal to the applicant 9129-6509 Quebec Inc and the Ontario Lands Tribunal Office.
-I was notified by the Ontario Lands Tribunal office (name with held) that my letter to their office was received November 24, 2021. It was considered too late and my Seeking Leave to Appeal was denied.
-The next year, the same Ministry employee contacted me as to why he never heard anymore about my Seeking Leave to Appeal?

Because I had not been given any notification of application to open this waste site, I was denied my right to participate in certain government decisions effecting the environment.
-In 2022, I found out by letter from MOE staff, which i have a copy. that the applicant was to notify 232241 Dairy Lane ( my home address) in the original ERO 019-3990.
-No notification was ever given to my wife or I, owners at 232241 Dairy Lane.
Under Ontario Law it is an offense under 184 of the EPA and section 98 of the OWRA to give false or misleading information to the ministry related to these Acts or their regulations. A conviction for the offence of providing false information may result in a fine, imprisonment or both.

-I made several concerns about specific points of risk at this site to the Minister in my appeal.
-I feel once the MOE has been made aware of specific risks, it is the MOE responsibility to do due diligence.
I pointed out that that the sealed earthen berm was at risk because the lagoon is built into an old cement barn yard and manure pit with cement floor.
-The earthen berm was built with the old cement contaminating the clay.
-I pointed out that there was an abandoned well within 100 meters of the sewage lagoon.
-I pointed out there are field tiles within feet of the clay lagoon berm.
-I pointed out there is a municipal drain catch basin draining into Ontario Legacy Lands. The water being pumped out of the site lagoon on November 12, 2021 was draining into this catch basin.
-I also had concerns about an Ontario Licensed dairy farm milk house and barn approximately 100 meters from the sewage lagoon, and flies carrying disease.
-I had concerns as to how Ontario could license two incompatible operations so close together...food and human sewage.
The MOE staff ignored my concerns until October 21, 2022 when the MOE finally ordered the reconstruction of the lagoon to remove the old concrete. Environmental Compliance Approval 2758-C76MJA.
-we were provided the engineer's original blue print with 12 inches of old concrete abutting through the clay berm into the lagoon under the 1 meter freeboard level.
- my concerns as to why an engineer would design a sealed earthen berm to have 12 inches of old concrete in it, have never been answered.
Curiously, the same engineer design and old concrete is still used in the renewal package provided to the MOE by the applicant. Despite the lagoon berm being deconstructed October 2022.
- Oct 2022, the waste site lagoon was excavated during operation of the waste site without any new ERO notice to Ontarians.
-No notice was given to local residents from the MOE to take precautions of their own drinking water from the local ground water.
The old concrete and underlaying aggregates ran directly to the abandoned well. According to the MOE Ground Water Well Site, this well has never been decommissioned yet.
-The decommissioning of that well should have been done before the lagoon was torn apart and rebuilt.

-On this day, the applicant, 9129-6509 Quebec Inc delivered a notification of ERO 019-8483 to our home.
-My wife informed him that it was rather late, that we should have been notified earlier of the new application.
-When I mentioned my concerns about the field tile being so close to the lagoon and in the spreading zone, he told my wife and I, that the owner of the site property told him there are no field tiles in that field.
-I watched this field being tiled across from our home several years ago by this present farm owner.
-Under MOE regulations no one is allowed to put a residence's septic bed close to field tiles yet the MOE allows millions of liters of raw human sewage to be stored next to these field tiles.
-these tile outlets release this water right to Ontario water courses and fisheries.
When I made my concerns about the operator spreading raw sewage by spraying it above ground in high winds towards my home, which contravenes his ECA, the operator said he depends on hiring local dairy farmers to spread it on their time table, when they have time.
-He said he schedules a time to spread, often a week ahead and cannot know what the weather will be that day.
This is no excuse to spread during risky weather patterns.
-Under his ECA he is not to spread raw sewage in high winds or in precipitation events.
-June 20,2022 on this site there were three non compliances during sewage spreading by the MOE North Bay supervisor.
#1, Spreading during a rain event
#2. Failure to inject/incorporate into soil.
#3 Spreading outside of approved Boundaries
Twice the operator spread sewage that blew directly to my house in high winds from the south west.
The operator, 9129-6509 Quebec Inc. has had three years to obtain correct equipment to spread properly under MOE regulations, yet has not done so. He risks Ontario's environment by using outside contractors to spread it, when it fits into their dairy operation time table.
According to a map provided by Hydrogeology Consulting Service who consults for
9129-6509 Quebec Inc, the closest spread zone to my house is 380 meters (1,246 feet).
-After thinking that this could not be correct, because my wife said she felt sewage mist hit her as she stood on the road while the operators spread, we measured the distance on the Jim Semple Farm which is across the fence row from the spread zone.
The distance from our house to the wood lot on the map is 313 meters.
-We have drone pictures of the spreading zone in 2022 20 meter approximately east of the wood lot.
-The spreading zone is approximately 293 meters from our house, not 380 meters as the official ECA map show.
The renewal of this ECA under ERO 019-8483 reference 7462-D3HP58 should be stopped.
There are too many issues still not regarded or corrected from the original ECA.
-The operator has had three years from the original application to show his respect for Ontario laws and environment and has ignored his responsibilities under his ECA.
This was the wrong place to place a raw sewage storage facility and spreading zone. It should have never been approved.
