The Ministry of the Environment, Conservation and Parks (ministry) has closed the file and will not be issuing a Renewable Energy Approval for the Newbiggen Drive solar project proposed to be located at Part of Lots 18-20, Range 2, in the Municipality of Southwest Middlesex, County of Middlesex.
During the ongoing review of the file for the Newbiggen Drive Solar Project, the ministry amended the Renewable Energy Approvals Regulation (Ontario Regulation 359/09) to impose new requirements on renewable energy applicants, requiring them to demonstrate that the project fulfils an electricity demand and that the project is not prohibited by municipal zoning requirements.
These changes meant that current and future applicants would need to provide documentation demonstrating that the proposed project fulfills an authorized need for the electricity produced and that the proposed use of land at the project location is not prohibited by a zoning by-law or zoning order under the Planning Act. These changes to the regulation were made applicable to any existing applications that had been submitted but not decided prior to the amendments coming into force.
On September 13, 2022, this proposal notice was updated to advise the public that this file was still under review since the ministry was awaiting the additional information from the applicant in relation to regulatory requirements changes.
The ministry did not receive the required additional information and we have closed this file.

If you’re an Ontario resident, you can appeal this Renewable Energy Approval by submitting a notice of appeal to the Environmental Review Tribunal (ERT).
The ERT usually has to issue their decision within six months of receiving your notice.
Notice of appeal
To appeal this decision you need to do these three things:
- prepare an application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following two things in your application:
1. A document that includes:
- your name, mailing address, phone number and/or email address
- the name and address of anyone representing you
- the ERO number and ministry reference number (located on this page)
- that you’re appealing a decision about a Renewable Energy Approval
- the parts of the Renewable Energy Approval that you’re challenging
- how this project could cause serious harm to human health
- how this project could cause serious and irreversible harm to plant life, animal life or the natural environment
- the issues and facts you plan to present at the hearing
- the outcome you’d like to see
- whether you’ll request that the decision be postponed (i.e. seek a stay)
2. A copy of the decision (i.e. Renewable Energy Approval) that you’re appealing. You’ll find this in the decision notice on the Environmental Registry.
What is considered
The only grounds for appealing a Renewable Energy Approval are that engaging in the project in accordance with the Renewable Energy Approval will either:
- cause serious harm to human health
- cause serious and irreversible harm to plant life, animal life or the natural environment
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re appealing this decision. Please include a brief description of the:
- decision that you wish to appeal
- grounds for your appeal

3. Mail your application
You’ll need to mail your package that you prepared in step #1 to each of these three parties:
- appellate body

Description of instrument
This posting is for a proposed Renewable Energy Approval by CFT FIT 4 GP Inc., as general partner for and on behalf of MNO Solar FIT 4 LP for the Newbiggen Drive Solar Project proposed to be located at Part of Lots 18-20, Range 2, in the Municipality of Southwest Middlesex, County of Middlesex. This is a Class 3 solar facility with a nameplate capacity of up to 500 kilowatts.
The proposed facility is considered to be a Class 3 solar facility under the Renewable Energy Approval regulation (Ontario Regulation 359/09) under Part V.0.1 of the Environmental Protection Act. Applications for Renewable Energy Approvals are required to be submitted in accordance with the Renewable Energy Approval regulation for consideration for approval.
Other information
This comment period is for the public to review the proposal and provide comments and input directly to the ministry.
Within 10 days after the posting of this instrument proposal notice, the proponent will:
- publish a notice in the local newspaper to advise the public that this proposal has been posted on the environmental registry for comment
- make available copies of any documents submitted as part of the application by posting the documents on the proponent’s website, if the proponent has a website. Note that this requirement is set out in sections 15.1 and 15.2 of the Renewable Energy Approvals regulation
