Détails de la décision

The application for a plan of subdivision was draft approved on October 24, 2025, subject to conditions.

The application was reviewed for consistency with the environmental policies of the Provincial Planning Statement. Two comments were received as a result of the ERO posting. Four comments were received via email. Conditions were added to address partner ministry concerns relating to public health and safety, fish habitat, species at risk, and water quality.

Conditions include: the requirement for a flowage easement to define flood levels; the requirement for an easement for access and utilities over Block 21; the requirement for a subdivision agreement that addresses matters such as the avoidance of fish habitat, development restrictions around an archaeological site, and the need for landowners to follow best management practices for waterfront development; and notices to be included within agreements of purchase and sale in the event that species at risk are found on site/off shore.

The applicant has three years to satisfy conditions of draft approval, otherwise approval will lapse. The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before November 13, 2025.

Détails de la proposition

The purpose of this application is to create twenty (20) new lots through a Plan of Subdivision from PIN 42150-2328 which is the majority of an island south of Crow Rock Island on Lake of the Woods. The existing lot is approximately 36 hectares in size, with the largest proposed lot being 2.958 hectares and the smallest being 1.001 hectares. All lots have 60 metres or more of shoreline frontage and various depths from 69.63 metres to 238.30 metres. Currently nineteen (19) of the lots are vacant while lot 1 contains a dock and a cottage serviced by an existing septic system approved by the Northwestern Health Unit (NWHU). The lands are currently and proposed to be used for resource-based recreational use (cottaging) and will be sold as vacant lots. The lots are proposed to be serviced by individual onsite sewage and water systems (class IV septic and lake water). Development of cottages on each lot is expected.
