The application for a plan of subdivision was draft approved on January 28, 2025 subject to conditions.

The application was reviewed for consistency with the environmental policies of the Provincial Planning Statement. No public comments were received as a result of the ERO posting. Conditions were added to address partner ministry concerns relating to public health and safety, fish habitat, significant wildlife habitat, species at risk, and water quality.

Conditions include: the requirement for a flowage easement to define flood levels; confirmation of rehabilitation of a mine shaft; the requirement for a subdivision agreement that addresses matters such as the protection of active eagle nests, the avoidance of fish habitat, and the need for landowners to follow best management practices for waterfront development; and notices to be included within agreements of purchase and sale in the event that species at risk or wild rice are found on site/off shore. 

The applicant has three years to satisfy conditions of draft approval, otherwise approval will lapse. The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before February 17, 2025.

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

There is an additional “leave to appeal” right under the Environmental Bill of Rights.

Who can appeal

A notice of appeal can be submitted by:

  • individuals
  • corporations
  • public bodies

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Notice of appeal

Your notice of appeal must include:

  • the specific part, or parts of the official plan amendment that you wish to appeal
  • the reasons for your appeal
  • the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

The purpose of this application for subdivision is to sever Burley Island on Lake of the Woods, (PINs 42150-2444 and 42150-2700), a 12.54 hectares property, into a total of seven (7) lots for resource-based recreational use, and two (2) blocks to be considered for development at a later date. Lots range in size from 1 to 2.162 hectares. Currently there is one recreational property and camp on the east central side of the island. The island is currently vacant and will be serviced by individually approved and installed sewage systems and lake water.

The property can be accessed by water from Northern Harbour or Lake of the Woods Docking (Two Bears Marina) where parking and public boat launches are available. The subject lands are located in Bald Indian Bay approximately 4 kilometres south of the City of Kenora municipal boundary.
