The retained lot has access to Highway 605.

The application for consent, 58-C-231173 is draft approved subject to conditions. The applicants have two years to satisfy standard conditions of draft approval, otherwise approval will lapse. The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before September 16, 2024.

Conditions include:

1. That prior to final approval, the Ministry is to be provided written confirmation from a registered Ontario land surveyor verifying that all buildings and structures indicated as being located within the boundary of the proposed severed lot are actually located entirely within the boundary of the proposed severed lot.

2. That prior to final approval, an archaeological assessment (and any further assessments, as recommended) must be prepared by a licensed archaeologist under the Ontario Heritage Act on the entire property and submitted to the Ministry of Citizenship and Multiculturalism (MCM). Existing structures 40 years or older should also be evaluated for cultural heritage value or interest. Any assessment(s) must conform to the standards and guidelines for Consultant Archaeologists and the terms and conditions of the license issued to the archaeologist under Part VI of the Ontario Heritage Act. The licensed archaeologist should forward a copy of the MCM review letter to MMAH. The review letter should indicate that the reports have been entered into the Ontario Public Register of Archaeological Reports where those reports recommend that:

a. all archaeological assessment of the subject lands is complete or

b. all archaeological sites identified by the assessment are either of no further cultural heritage value or interest (as per Section 48(3) of the Ontario Heritage Act) or that mitigation of impacts has been accomplished through excavation or an avoidance and protection strategy.

3. That prior to final approval, the Ministry is to be provided by the applicant with written verification from the Ministry of Transportation (MTO) stating that entrance permits will be made available for both the proposed severed and retained lands.

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

There is an additional “leave to appeal” right under the Environmental Bill of Rights.

Who can appeal

A notice of appeal can be submitted by:

  • individuals
  • corporations
  • public bodies

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Notice of appeal

Your notice of appeal must include:

  • the specific part, or parts of the official plan amendment that you wish to appeal
  • the reasons for your appeal
  • the appeal fee, payable by certified cheque or money order to the Minister of Finance, Province of Ontario

The purpose of this application is to create one new resource-based lot from the property described as PIN 420700-0268.The proposed new lot will have approximately 244.80 metres of frontage, a depth of 179.59 metres and an area of 4.66 acres. The proposed new lot has an existing commercial business on it which includes an equipment yard, an office, a shop, garage, two septic fields, two septic tanks and a well. The retained lot will have approximately 420.7 metres of frontage, 158.2 metres in depth and an area of 118.95 hectares. The retained lot has an established existing house, garage, septic tank, septic field and a well.
