The application for consent was draft approved on May 6, 2025 subject to conditions.
The application was reviewed for consistency with the environmental policies of the Provincial Planning Statement. One public comments was received and responded to, and conditions were added to address partner ministry concerns relating to access, land use, archeological potential, and natural heritage.
No specific concerns related to fish or wildlife habitat, species at risk, protected areas or public health and safety were identified in relation to this application. Given the small-scale of development and mitigation measures there will be no negative impacts to greenspace, natural heritage and water quality and quantity, nor public health and safety.
Conditions include: access requirements, consent agreement ensuring use for resource-based recreational purposes, assessments with recommended actions taken (Archeological Assessment, Significant Wildlife Assessment, Wildland Fire Risk and Hazard Assessment); confirmation of adequate capacity for disposal of sewage and garbage; and an acknowledgement signed by the transferor and transferees if the transaction is between family members, that they have read the standard information provided, including best management practices for shoreline development. .
The applicant has two years to satisfy conditions of draft approval, otherwise approval will lapse. The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before May 26, 2025.

As a result of the ERO posting, an emailed inquiry with reference to the ERO number was received. Information was requested in regards to which First Nations were notified of this proposal. Answer was given via email, no further communication received. No further action taken.

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

The purpose of this application is to create one of three new resource-based recreational lots.
Proposed new Lot 1 will have approximately 76 metres of frontage, approximately 450 metres of depth and an approximate area of 3.2 hectares. The retained lot approximately 76 metres of frontage, approximately 450 metres of depth and an approximate area of 3.5 hectares.
The retained lot currently has a cottage that is proposed to be renovated or removed. The three new lots are vacant land with the potential for future seasonal residential dwellings to be built. Private servicing is proposed for all lots.
Lot 2 is proposed under ERO#019-8856 under application 58-C-241246. Lot 3 is proposed under ERO#019-8857 under application 58-C-241428.
The subject lands are located on Worthy Lake in the Unincorporated Township of Upsala, approximately 4 kilometres northeast of the townsite of Upsala and approximately 100 kilometres northwest of the City of Thunder Bay. Access to the subject land is by Highway 17, local roads board-maintained road, North Road, and surveyed easement access.
