An approval was granted to Dockside Marine Inc. is for an amendment of Environmental Compliance Approval No. 3-0246-80-006 for the proposed sewage works expansion and upgrade serving Northern Harbour Marina that consists of existing 229 docking slips, proposed 372 additional docking slips, comfort stations (washroom and shower facilities), fuel supply, mechanical/repairment service, and boat storage facilities, located at 361 Northern Harbour Road, Township of Kirkup.
The approved sewage works include an existing and a new clay-lined sewage treatment lagoon cells with a total an active operation volume of approximately 6,212 cubic metres at an active water depth of 1.5 metres (between 0.3 metres to 1.8 metres), an expanded spray irrigation pipe system with a total of fifteen 22.5 metres radius spray circles within an existing approved wood land for spray irrigation, as well as four existing holding tanks serving a residence, a cottage, two shops and an office.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal from Dockside Marine Inc. is for an amendment to Environmental Compliance Approval No. 3-0246-80-006 for the proposed sewage works expansion and upgrade serving Northern Harbour Marina that consists of existing 229 docking slips, proposed 372 additional docking slips, comfort stations (washroom and shower facilities), fuel supply, mechanical/repairment service, and boat storage facilities, located at 361 Northern Harbour Road, Township of Kirkup, Ontario.
After the proposed expansion and upgrade, the current sewage works includes a 22,600-litre sewage pump out tank at the dock, a 8580-litre sewage lift station at the dock that pumps to the 13,000-litre sewage lift station (equipped with overflow alarms and a back-up pump system) that transfers all effluent to the sewage treatment lagoon. There are 2 sewage holding tanks on site (at the owner’s residence and at the shop that are pumped out regularly by a licensed sewage hauler (there are no septic tanks/fields on site)).
At present a single cell existing lagoon with a proposed slight height increase thus increasing surface area to 2,063 square metres with an maximum effluent depth of 2.50 meters and resultant capacity of 5157 cubic metres plus a new lagoon cell with a capacity of 3,227 cubic metres and a water depth of 2.50 metres, as well as a pump-out chamber and pipelines for discharge effluent for spray irrigation in a significantly large woodland with a much larger expanse than the required total area of spray circles of 12,720 square meters or 1.3 hectares, that located immediately to the north and west of the present single cell lagoon. (This area has been used for the spray irrigation of the present lagoon for the past 44 years and has ample room for the additional treated effluent to be sprayed).
