Approval is granted to amend an Environmental Compliance Approval (ECA) No. A591104 for a Waste Disposal Site (transfer/processing) located at 26 Haniak Road, Rosslyn, Ontario. The site is approved to receive, process and/or transfer:

  • non-hazardous waste;
  • liquid industrial;
  • hazardous waste;
  • non-regulated items for recycle; and
  • non-hazardous contaminated excess soil, including liquid soil

The site is approved to receive a maximum of 1,000 tonnes daily, limited to 200 tonnes of hazardous waste per day, and a maximum of 365,000 tonnes on an annual average basis of Non-Hazardous waste, Liquid Industrial, Hazardous Waste, non-regulated items for recycle, and non-hazardous contaminated excess soil, including liquid soil.

The site is approved to operate 24 hours a day, 365 days a year with a service area of Canada and the United States of America.

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

  • appellate body

GFL Environmental Services Inc. (GFL) is applying to amend an Environmental Compliance Approval (ECA) No. A591104 for a Waste Disposal Site (Transfer/Processing) located at 26 Haniak Road, Rosslyn, Ontario.

The function of this site is to receive, process and/or transfer Non-Hazardous waste, Liquid Industrial, Hazardous Waste, non-regulated items for recycle, and non-hazardous contaminated excess soil, including liquid soil. The Site currently occupies approximately 11 hectare of land and is located 26 Haniak Road, Lot 3, Concession 2 in the Municipality of Oliver Paipoonge, District of Thunder Bay.

The Site footprint will include the following components: a 1,000-cubic meter tank farm and loading/unloading concrete pad, to include up to twenty-one (21) double wall above-ground storage tanks with a maximum capacity of 90,000 liters each; 320-square meter fabric shelter building comprised of concrete reinforced containment walls, and concrete reinforced slab, for the installation of 280-square meter mixing and solidification pads with containment curbs, having a maximum storage capacity of 200 tonnes; 220-square meter concrete pad with containment curbs to provide stability and containment for up to four (4) dry van trailer used for the temporary storage of containerized waste; and up to eight (8) roll off containers for the temporary storage of non-hazardous and Hazardous solid industrial waste.

Roll Off containers may vary in physical dimensions and sizes, but the total weight shall not exceed 30,000 kilograms per container; 640-square meter building expansion for the temporary storage of containerized waste Non-Hazardous Solid, Liquid Industrial, Hazardous Waste and non-regulated items for recycling, not to excess 2,000 drums or its equivalent; 220-square meter new building specially designed for the storage of containerized flammable waste, not to excess 1,000 drums or its equivalent; and 240-square meter concrete pad with containment curbs and to provide stability to the mixing bins for the purposes of consolidating and solidifying non-hazardous and hazardous sludge waste materials.

The site is requesting approval to receive a maximum of 1,000 tonnes daily, limited to 200 tonnes of hazardous waste per day, and a maximum of 365,000 tonnes on an annual average basis of Non-Hazardous waste, Liquid Industrial, Hazardous Waste, non-regulated items for recycle, and non-hazardous contaminated excess soil, including liquid soil. GFL is requesting the ability to accept waste 24 hours a day, 365 days a year with a service area of Canada and the United States of America. Most activities are expected to take place during business days and business hours.
