Establishment of industrial stormwater management works to serve 2079 Artistic Place Inc. located in the City of Ottawa, for the collection, transmission, treatment and disposal of stormwater runoff from a total catchment area of 3.7 hectares, to provide enhanced level water quality protection and erosion control. And to attenuate post-development peak flows to allowable peak flow of 100 litres per second at the 100-year storm event, to discharge into the existing 1800 millimetres diameter municipal storm sewer located within the property, and ultimately flows into the Saw Mill Creek Trunk sewer, consisting of the following:
- thirteen (13) dry ponding areas to discharge into the underground storage tank as described below
- underground storage tank, located at the central area of the site, consisting of Green Storm ST (or approved equivalent) pipe sections in underground with exposed (open) bottom storage volume of 1065 cubic metres, complete with control orifice to discharge into 1-525 millimetres, diameter storm outlet pipe at a maximum allowable flow rate of 91 litres per second under the 100-year storm event into the oil and grit separator as described below
- oil/grit separator (stormceptor model EF012 or approved equivalent) having a sediment storage capacity of 31,220 litres, an oil storage capacity of 2475 litres, a total storage volume of approximately 33,695 litres, and a maximum treatment rate of 93.7 litres per second, discharging via a 525 millimetres diameter outlet pipe into the 1800 millimetres diameter municipal storm sewers; and
- a dry pond with a depth of 1.9 metres to accomodate 100-year storm runoff having a volume of 541 cubic metres to intercept runoffs from the Building A site and nearby parking areas located at the north side of the site to discharge via 55 millimetres diameter control orifice plate on a headwall into 1-250 millimetres diameter outlet pipe at a maximum allowable flow rate of 9 litres per second into an oil and grit separator as described below
- oil/grit separator (stormceptor model EF06 or approved equivalent) having a sediment storage capacity of 3,470 litres, an oil storage capacity of 610 litres, a total storage volume of approximately 4,080 litres, and a maximum treatment rate of 23.4 litres per second, discharging via a 1-250 millimetres diameter outlet pipe into the 1800 millimetres diameter municipal storm sewer

If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application
