The establishment of industrial stormwater management Works to service a Car Wash Facility, located west of Palladium Drive for collection, transmission, treatment and disposal of stormwater run-off from a total catchment area of 0.54 hectares, to provide Enhanced Level water quality protection and erosion control, and to attenuate post-development peak flows to an allowable release rate of 105 litres per second for all storm events up to the 100-year storm event, discharging to 825 millimetres diameter existing municipal storm sewers on the Cabela's Way.
Proposed works include dry surface ponding on the driveways, having a maximum volume of 74.97 cubic metres at a maximum depth of 0.30 metres, complete with ICD control located at CBMH06 and provision of emergency overflow spillover point towards Cabela's Way for storms exceeding the 100-year storm events.
Collection and Conveyance 250 millimetres diameter to 450 millimetres diameter oversized collection and storage pipes fitted with ICD control located at CBMH06 and an Oil/grit separator for quality control.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is for a new Environmental Compliance Approval (sewage) for the establishment of a stormwater management facilities to service the proposed Halo Car Wash, located west of Palladium Drive with its entrance off Kanata West Center Drive.
The proposed development is approximately 0.54 hectares in size, and will be serviced by new storm sewers to be connected with the existing storm sewer located south along Cabela’s Way. The proposed sewage works include storm sewers and an underground storage facility.
The stormwater management quantity control objective will be achieved by restricting the flow using an inlet control device (ICD) and on-site stormwater surface and underground storage. The storm runoff quality treatment will be provided via the downstream approved wet pond “Pond 6 West” located west of Palladium Drive.
