The establishment of industrial stormwater management Works to serve Furoy's Insulation Site development located in the in the City of Greater Sudbury, for the collection, transmission, treatment and disposal of stormwater run-off from a total catchment area of 0.41 hectares, to provide Enhanced Level water quality protection and erosion control, and to attenuate post-development peak flows to pre-development peak flows for all storm events up to and including the 100-year storm event, discharging to existing roadside ditch located along Radisson Avenue; consisting of the following:
Proposed Works:
- Interception and Conveyance Swale: located along the perimeter of the site (north, east and south sides) having a total length of 182 metres, a width of 1.0 metres, a V-shaped ditch 150 millimetres deep; to intercept and discharge run-off being naturally conveyed from the site perimeter and adjacent properties toward the roadside ditch along Radisson Avenue.
- Vegetated Filter Strip Dry Ponding Areas: located at two road side corners having a total area of 340 square metres and a maximum available storage volume of 65.50 cubic metres at a maximum depth of 330 millimetres, complete with curb cut inlets; 450 millimetres diameter piped outlets into the OGS unit and riprap-lined emergency overflow weir spillway toward the roadside ditch on Radisson Avenue.
- Interception and Conveyance of Parking Areas: Parking and asphalted loading and unloading works area run-offs are intercepted and conveyed via surface grading towards outlets and gutters into 850 millimetres wide 125 millimetres deep drains, positively sloped towards the OGS units to discharge up to 25 millimetres event flows only; allowing overflow the balance flow into the vegetated filter strip dry ponding areas.
- Oil/grit Separators (Stormceptor Model EF04): located at the two site corners by the Radisson Avenue; each having a sediment storage capacity of 1190 litres, an oil storage capacity of 265 litres, a total storage volume of approximately 1455 litres, and a maximum treatment rate of 425 litres per second; to discharge via 450 millimetres diameter outlet pipes over riprap apron into the roadside ditch on Radisson Avenue.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

The stormwater management works comprise of two on-site Stormwater Quality and Quantity Control facilities, which both include a vegetated filter strip/dry pond basin and hydrodynamic oil/grit separator technologies, and will discharge to an existing roadside ditch located along Radisson Avenue.
