On October 22, 2019 we approved new Environmental Compliance Approval No. 5454-BD4M2Q for 2299647 Ontario Limited to establish sewage works at 4712 County Road 90 in the Township of Springwater, Ontario. The new sewage works will consist of the collection, transmission, treatment, and disposal of stormwater and sanitary sewage effluent from a commercial gas bar redevelopment.

The stormwater management works is to provide enhanced level of water quality protection and to attenuate post-development peak flows to pre-development levels, discharging to Bear Creek, for all storm events up to and including the 100-year return storm.

The works includes the following:

  • site storm sewers
  • one oil and grit separator
  • one swale

The sanitary sewage treatment and subsurface effluent disposal system is to service one (1) drive-in restaurant, one (1) convenience store, one (1) gas bar and one (1) auto repair garage, with a daily sanitary sewage flow of 19,070 L/d.

The system includes the following:

  • collection and holding tank
  • grease interceptor
  • collection sewer
  • anaerobic digester tanks
  • aeration tank
  • balancing tank
  • closed loop tank
  • biofilter denitrifying tank
  • polishing tank and pumping
  • for subsurface disposal, a fully raised Type A dispersal bed

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

Description of instrument

This proposal is for a new Environmental Compliance Approval (Sewage Works) for 2299647 Ontario Limited.

This application is to establish sewage works for the collection, treatment, and disposal of up to 19,000 litres per day of effluent, and collection and control of stormwater peak flows up to and including the 1 in 5 year storm event at 4712 County Road 90 in the Township of Springwater.

Treatment of effluent includes a Waterloo Biofilter System consisting of;

  • an aeration tank,
  • balancing tank with two (2) alternating effluent pumps,
  • two (2) biofilter tanks,
  • two (2) anaerobic digester tanks, below ground flow meter chamber, and
  • separate grease interceptor for kitchen wastewater.

All tanks are to be connected via gravity sewer and/or forcemain, and the system will discharge to an above grade Type "A" dispersal bed located north of Bear Creek, on an adjacent property also owned by the applicant.

The stormwater system includes a storm sewer system sized to provide detention storage, and a Continuous Deflective Separator (CDS) Model 2015-6-C Oil/Grit separation with oversized oil capture volume, which achieves 80% Total Suspended Solids removal as per Ministry of Environment Enhanced Treatment Requirements. The storm sewer system will terminate at a concrete headwall located at the 15m setback from Bear creek and be conveyed by river stone line channel with trapezoidal cross section featuring a 1m wide bottom and 3:1 side slopes.
