The application was for an amendment to the existing Environmental Compliance Approval (waste disposal site) No. 6922-96UNVK, issued on December 1, 2020, for the use and operation of a waste disposal site with a total area of 0.40 hectares for the transfer and processing of non-hazardous municipal waste, specifically empty oil, antifreeze, and other containers (e.g., drums, totes, and similar containers).

The purpose of the application was to include additional waste classes (242 L/T and 269 L/T for empty pesticide containers), adjust receiving and shipping hours to a 24-hour, 7-day schedule, and increase the daily processing capacity to 30,000 kilograms, with a maximum on-site storage limit of 90,000 kilograms at any time.

These containers will be received, baled, and compacted on-site and subsequently transferred to a processing facility in Quebec following processing.

The proposal was posted on the Environmental Registry of Ontario (ERO) for public comment on July 17, 2025, for a 45-day comment period (ERO #025-0816), which closed on August 31, 2025.

A notification letter was sent to the Clerk’s Office of the City of Burlington on July 14, 2025. The applicant notified neighbouring properties of the application in July 2025 and subsequently hand-delivered an additional round of notifications to adjacent properties on April 27, 2026. These notifications included information on operating hours, receiving and shipping hours, and the addition of new waste classes.

No comments were received from the notified neighbours, municipalities, or through the ERO posting.

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

This proposal is for an amendment to the existing Environmental Compliance Approval (waste disposal site) No. 6922-96UNVK which was issued for the use and operation of waste disposal site with a total area of 0.40 hectares, to be used for the following: transfer and processing of non-hazardous municipal waste of empty oil, antifreeze and other containers (drums, totes and other types having reach their end of life.

Those containers will come from a variety of recuperation centres of plastic and program’s like: Stewardships from Ontario.

Those plastics will be transferred throughout the Burlington facility to our Quebec facility using a baler to compact products at a total rate of 15-22 tonnes per day and with a maximum total storage of 80 tonnes at any one time. This amendment is to change the following, operation hours change to 24 hours, 7 days a week, and add waste class numbers: 242 L/T and 269 L/T. and to allow RPM to collect heal from totes and drums so that plastic containers can be recycled. Heal is bulked in a 208 litres drum and transferred to approved disposal site.

The site operates normally Monday to Friday, 7:00 am to 3:30 pm and services the Province of Ontario. The site location of the facility is 3166 Mainway, Burlington, Ontario.
