Retail mobile fueling is currently happening in the province of Ontario. The current Liquid Fuels Handling Code 2017 (LFHC 2017) does have requirements for this activity. TSSA is currently updating/revising the LFHC 2017 and has reviewed/revised the safety requirements regarding this activity in consultation with the industry stakeholders.
New definition - Retail Mobile Fueling
Retail Mobile Fueling - the dispensing of fuel from a highway tank to a licensed vehicle or a watercraft that cannot be fueled at a marina.
Amended clause 5.8.1
5.8.1 Retail mobile fuelling shall comply with Appendix I. Mobile fueling to a boat or the bulk storage tank on a highway tank is prohibited.
Appendix I – Retail Mobile Fueling Requirements (Normative)
I.1 Only highway tanks licensed under O. Reg. 217/01 section 10.2 are permitted for use in retail
mobile fueling.
I.2 A minimum of a 80-B:C fire extinguisher and a spill kit shall be located on the highway tank.
I.3 Spill kits shall be readily available during fueling operations and they shall contain:
I.3.1 Twenty heavy weight spill pads (hydrophobic 45cm x 60cm)
I.3.2 Two spill socks (hydrophobic 1 m. long)
I.3.3 Five disposable bags to contain contaminated pads/socks
I.3.4 One - 16 KG bag granular absorbent (non-silica and hydrophobic)
I.3.5 One drain cover - 1m x 1m (catch basin cover)
I.3.6 Dike putty (to plug holes in tank)
I.4 Nozzles used for dispensing shall be no greater than 25.4mm (1in) in diameter and shall be of
the automatic shut-off design. The operator must be in attendance (within arms- reach) of the
nozzle during fuel transfer.
I.5 Hoses through which the product is transferred shall not exceed 61 m (200 ft), and an
appropriate storing mechanism shall be used to prevent damage to the hose. Hoses shall be protected
from damage while in use and stored on the storing mechanism when not in use.
I.6 Highway tanks shall be equipped with a beacon light that shall be in operation during fueling
operations. The light shall be designed to be readily visible to other people or vehicles entering
the fueling area.
I.7 Product shall only be transferred by means of pumping. The pump shall be equipped to prevent
siphoning of the tank should a leak occur in the fuel nozzle, hose, or pump.
I.8 During fueling, the international no smoking symbol at least 10cm in diameter shall be
displayed on the front and rear of the dispensing vehicle.
I.9 Dispensing requirements
I.9.1 Dispensing shall not take place within
(a) a building;
(b) 30 m of a stream, river, lake, canal, or natural watercourse;
(c) 3 m of a property line;
(d) 4.5 m of any opening in a building;
(e) 3 m from any source of ignition;
(f) 3 m from any highway as defined in the Highway Traffic Act, except as requested by an emergency
services provider;
(g) A parking garage/structure; or,
(h) On the roof of any building or structure
I.9.2 The requirements of Clause I. 9.1, items (b) to (d), may be modified where the mobile fueler
has a procedure in compliance with the following to mitigate the escape or loss of product:
(a)The operator dispensing the fuel shall have a spill pad on their person during dispensing.
(b) An approved automatic shutoff nozzle shall be used to dispense the fuel.
(c) Class I product (e.g. gasoline) shall not be dispensed at a rate in excess of 38 L/min.
(d) Class II product (e.g. diesel fuel) shall not be dispensed at a rate in excess of 120 L/min.
I.9.3 The mobile fueler shall have a spill response procedure, and personnel shall be trained in
the containment, cleaning up, and reporting of spills in accordance with the requirements of Clause
8.2 of this code.
I.9.4 When fueling Class I product, the engines of vehicles being fueled shall be shut off prior to
and during fueling.
I.9.5 Hoses shall not extend under vehicles and shall be positioned in a manner to prevent traffic
from driving over the dispensing hose.
I.9.6 A cover shall be installed over any storm/sanitary sewer openings that are within 3 m of the
fuel filling position.
I.10 Dispensing tanks shall be maintained to ensure the safe operation of the vehicle while
transporting, loading, and dispensing products.
I.11 Mobile fueling operators shall have a safety and emergency response plan that establishes
policies and procedures for fire safety, spill prevention and control, personnel training, and
compliance with other applicable requirements of this code.
I.12 Dispensing tanks shall be operated only by personnel who are trained in proper fueling
procedures and the safety and emergency response plan. Training records of operators shall be
maintained
I.13 The following additional requirements shall be followed when fueling a watercraft that cannot
be fueled at a marina:
(a) Moor the watercraft to a fixed point, dock, buoy, work platform or wharf using mooring lines
(ropes) so that the watercraft stays in place, prevents it from drifting due to wind or currents
and allows for safe fueling operations.
(b) The highway tank vehicle and the receiving watercraft shall be bonded.
(c) Where possible, the highway tank vehicle shall be grounded to an earth stud located at the
dock, buoy, work platform or wharf.
(d) Where the fill position is located on the deck, scuppers within 3 m of the fill position shall
be plugged before the transfer of fuel.
(e) In addition to the fuel delivery driver, there shall be at least one other person designated to
aid in the fuel transfer. One person shall be located in close proximity to the truck’s emergency
shut off switch who is in direct communication with the other person who shall be located at the
fueling position. This communication shall be maintained until fueling is complete.
(f) An emergency stop procedure shall be agreed upon between the personnel identified in I.13(e)
prior to the transfer of fuel.
(g) The fuel transfer shall be initially supplied at low flow rate and monitored for leaks and
spills until safe fueling is established. Thereafter, the flow rate can be increased to its normal
setting.
(h) During watercraft fueling operations, the personnel identified in I.13(e) shall be checking for
leaks and spills and specifically scanning the area adjacent to the fueling operation for possible
leaks or spills.
(i) During watercraft fueling operations, in addition to the spill response equipment identified in
I.3, the following spill response equipment shall also be available and in close proximity to the
fueling area: four – 13 cm x 3 m Floating - Oil-Only - Sorbent Booms
(j) A minimum 80-B:C fire extinguisher shall be located on the watercraft being fueled and close to
the fueling location.
(k) For dispensing of class 1 product, no one other than the person identified in I.13(e) shall be
on board the watercraft during fueling.
(l) If equipped with an engine space blower, no person shall start up a gasoline- powered
watercraft unless the blower has been operated for a period of not less than four minutes
immediately before start-up.
(m) The fueling of the watercraft shall be limited to maximum of 90% of the watercraft’s fuel tank
capacity.
I.14 Notify the Director (TSSA) of a spill, leak, or discovery of a petroleum product that has
escaped to the environment or inside a building by phoning 877-682-8772.
