Existing wastewater systems WWTS 1, WWTS 3, and WWTS 6 are to be decommissioned. One new sewage treatment system (system A1) is being proposed to work in conjunction with some of the existing sewage system infrastructure currently in place at Springwood Cottage Resort.

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision

    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision

    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

You’ll need to mail your application that you prepared in step #1 to each of these three parties:

This proposal is submitted for an amendment to the Environmental Compliance Approval (ECA) no. 9604-9GJMYY for Springwood Cottage Resort (SCR) to establish sewage works for the collection, treatment and subsurface disposal of up to 25.60 cubic meters of domestic sewage per day, from a site located at 1018 Blue Heron Ridge, Township of Central Frontenac, County of Frontenac, Ontario. Although there is currently an ECA in place for sewage works (no. 9604-9GJMYY) issued March 13, 2014, the proposed systems referenced in the ECA were never constructed. There are nine sewage treatment systems currently located on the site.

Existing wastewater systems, WWTS 1, WWTS 3, and WWTS 6, are to be decommissioned as are all existing greywater treatment systems. One new sewage treatment system (System A1) is being proposed to work in conjunction with some of the existing sewage system infrastructure currently in place at Springwood Cottage Resort. The combined daily design sewage flow for the buildings that will be serviced by System A1 is 13,550 liters per day. System A1 will transfer 11,000 liters from the balancing tanks to the anaerobic digester tank (AD1) per day. This will then be distributed to a Waterloo basket biofilter tank (BB1). Level IV effluent from BB1 will then be treated for nitrogen in a Waterloo biofilter tank before ultimately being discharged to a shallow buried trench dispersal bed. The septic tank servicing Cottages #1, #2a and #2b will be disconnected from WWTS 1’s Leaching bed and converted into a pump chamber that will transfer wastewater to proposed System A1 via a 50 millimetre diameter forcemain. Cottage #14 will be disconnected from Existing WWTS 4 and its existing pump chamber will be replumbed to transfer wastewater to proposed System A1 via a 50 millimetre diameter forcemain.

Cottages #7, #8, #9, and #10 will be disconnected from existing WWTS 6 and WWTS 7 and connected to a new pump chamber (Pump Chamber A) that will transfer wastewater to System A1 via a 50 millimetre diameter forcemain.
Cottages #9 and #10 will be disconnected from existing WWTS 7 and connected to a new individual pump chambers that will transfer wastewater via a 50 millimetre diameter forcemain to proposed System A1.
