Approval is granted to 101172801 Saskatchewan Ltd. (Trirock Construction Limited) to operate a dry excess soil processing facility located at 5878 Highway 9 in Schomberg, New Tecumseth, County of Simcoe, Ontario. Approval includes the following:
- the site is approved to receive dry excess soils from sites in Ontario
- the site has a maximum daily receiving rate of 580 cubic metres of soils (995 tonnes) and a maximum total storage capacity of 25,000 cubic metres of soil (dry excess soil, processed, unprocessed waste and residual waste) at any one time
- all incoming dry excess soils are required to be source tested to ensure the approval requirements for all incoming dry excess soils are met
- the approved processing is grade/size based sorting using mechanical shaker
- the processed dry excess soils will be chemically tested prior to transfer off-site for beneficial reuse
- the facility is required to obtain site-specific section 9 (air, odour and noise) and section 53, OWRA, approval prior to the receipt of the waste
- receiving, processing, and shipping activities may take place between 6:00 a.m. to 7:00 p.m., Monday to Friday and 7:00 a.m. to 5:00 p.m. on Saturday

Start the process to appeal
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is for a new Environmental Compliance Approval (waste disposal site) for 101172801 Saskatchewan Ltd. (Trirock Construction Limited), the operator of the soil processing facility located at 5878 Highway 9 in Schomberg, New Tecumseth, County of Simcoe, Ontario.
The 3-hectare site will be used as a Class 1 Soil Management Site and resides within a 56.7 hectare works yard. The site will receive dry excess soils from Project sites in Ontario. The site has a maximum daily receiving rate of 580 cubic meters of soils (995 tonnes) and a maximum total storage capacity of 25,000 cubic meters of soil at any one time.
All incoming excess soils are tested to ensure the soil quality requirements are met for the soil processing facility. Accepted soils will be sorted using mechanical sieves in order to recover reusable soils for construction applications or similar. Once sorted and processed for re-use; the soil quality of the processed soil is tested prior to any outbound soil shipment. This sorting process will include some aggregate materials. Residual excess soils which do not have a commercial re-use are to be transported to a permitted off-site treatment or disposal facility.
Receiving, processing, and shipping activities may take place between 6:00 a.m. to 7:00 p.m., Monday to Friday and 7:00 a.m. to 5:00 p.m. on Saturday. The site occasionally provides services outside of the typical operating hours for emergency situations or short-term contract requirements (e.g., after hours and weekends).
