The approval will allow the company to improve upon and expand the waste management services they provide.

The decision to allow additional waste classes to be received and/or processed at the facility was made after consideration and review of the company's updated and improved standard operating procedures, housekeeping protocols, quality assurance procedures and contingency and emergency response plans.
No changes have been made to the facility's approved waste storage capacity or waste receiving rates.

1. General concerns were raised about the management of hazardous waste in a neighbourhood that includes homes, a park, schools, and a shopping district.
Response: We rely on municipal zoning to determine the suitability of citing certain waste management facilities. The Terrapure operation is permitted on the 52 Imperial Street property as per City Zoning By-laws.
2. Concerns were raised that granting this approval would lead to further stressing pollution in the area.
Response: The application does not request increases to the site's receiving, processing, storage or shipping rates. There are no emissions to the natural environment or increase in truck traffic expected as a result of allowing additional waste classes to be processed.
3. Concerns were raised regarding the performance of Terrapure and their level of care and concern within the community given the company's emissions release incident in 2016, including the company's ability to appropriately manage hazardous waste and any additional hazardous waste classes.
Response: Terrapure accepted responsibility for the incidents and 2016 and has since made a number of changes and improvements to their staff, operations and procedures.This followed an assessment of the facility conducted by a third-party engineering and consulting firm. The ministry will continue to inspect the facility to monitor compliance with the Environmental Compliance Approval, the EPA and its regulations and to ensure the site is being operated in an environmentally responsible manner.
4. Concerns were raised regarding noise levels for the hammer mill used to shred incoming waste batteries.
Response: The equipment proposed will be housed indoors within the confines of the larger processing building. The company has conducted a noise assessment for its staff only. Noise from this unit is not expected to be an issue for any residential receptors but the ministry has the ability to monitor any complaints received and respond should action be warranted.
5. Concerns were raised over the processing of waste for disposal at the Terrapure Stoney Creek industrial landfill.
Response: We will continue to monitor the Terrapure Stoney Creek landfill to ensure compliance with service area and fill rate conditions of their approval.
6. Concerns were raised with the level of financial assurance for the site.
Response: Financial assurance is due for re-evaluation in March of 2020. No increase to financial assurance has been imposed at this time as no increase to site storage capacity is being requested. We are currently satisfied with the amount being held in financial assurance.

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

Description of Instrument
This proposal is to amend the Environmental Compliance Approval (Waste Disposal Site) No. A100140 issued to Revolution Environmental LP (Terrapure Environmental). The processing/transfer facility is located on a 2.0 hectare site at 38-52 Imperial Street in Hamilton, Ontario.
The waste transferred/processed includes post-consumer waste batteries, non-hazardous waste and hazardous waste classes. The site is requesting through this amendment to allow for the acceptance of, processing of and transfer of the following additional waste classes: 111, 123, 133, 134, 135, 141, 142, 211, 212, 213, 231, 232, 233, 241, 242, 261, 268, and 269 in any primary classification.
Also, the design and operations report is being updated to include various types of processing equipment allowed for use at the site. Finally, miscellaneous changes to wording of conditions is proposed through the amendment application.
No other changes to the waste volumes received per day and processed per day, service area or operating hours are proposed.
The site currently has a service area of Canada and United States and is capable of operating 24 hours per day, 365 days per year.
