The sewage works collects groundwater and surface water runoff from the extraction area at the Hewitt Quarry's facility, for treatment in a settling pond prior to discharge offsite in a tributary of North River.
The amendment has imposed effluent limit for Boron and enhanced monitoring.
Effets de la consultation
The comment received expressed support for the amendment while requiring that enhanced monitoring of surface water and groundwater along with an adaptive management plan. In response to the comment, it is noted that monitoring of both surface water and effluent from groundwater dewatering will continue at this quarry.
Monitoring under Condition 7 of the amended ECA has been strengthen by requesting that in addition to monitoring of the "Settling Pond Effluent before its discharge to the southern watercourse", monitoring be performed "At Station R3 where discharge from the settling pond ultimately leaves the site overland". Moreover, effluent limit has now been imposed for Boron under Condition 5 of the amended ECA to ensure better environmental protection.
The Owner is required to report to the District Manager any exceedence within 10 days of the exceedence as stated in Condition 8 of the amended ECA, so that the Ministry can work with the Owner in resolving any problems in a timely manner.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is to amend the existing Environmental Compliance Approval (ECA) No. 0309-9SGMS5 that was issued on January 13, 2015 for the approval of effluent limits for the Hewitt Quarry's facility located at 2434 Brennan Line, in the Township of Severn, Ontario.
The previously approved sewage works consist of a sewage treatment system, which collects groundwater and surface water runoff from the extraction area.
The existing settling pond includes:
- a sediment forebay
- two filtration berms
- a low-flow outlet control structure, and
- an overflow spillway
Treatment is provided by a settling pond prior to being discharged offsite. Due to high boron concentrations in the groundwater surrounding the quarry, effluent from the existing settling pond regularly exceeds the effluent limits set in the existing ECA.
In this amendment application, new effluent limits are being proposed to better monitor the performance of the existing industrial sewage treatment system.
