Approval for the establishment of industrial stormwater management Works to service relocated expansion of Kawartha Wooden Stair and Rail Fabrication Facilities, located in the Township of Selwyn, for collection, transmission, treatment and disposal of stormwater run-off from a total catchment area of 0.94 hectares, to provide Enhanced Level of water quality protection and erosion control, and to attenuate post-development peak flows to pre-development peak flows for all storms up to and including the 100-year storm event, discharging to an existing wetland located downstream along the west side of the property; consisting of the following proposed Works:

  1. Enhanced grassed swale, to intercept surface run-off from the parking and truck moving areas of the site and located at the north perimeter of the property, having a total length of 29.0 metres, a bottom width of 1.0 metres, side slopes of 1:3, a maximum depth of 650 millimetres, a maximum flow depth of 180 millimetres (100-year storm event), to discharge into the proposed stormwater wetland facility as follows:
  2. Wetpond / wetland: One Stormwater Wetland Facility located on the west side of 1665 Chemong Road, having a permanent storage volume of 71.60 cubic metres at 750 millimetres depth, and an active storage volume of 211 cubic metres including the extended detention storage (under 100-year storm event), and includes a controlled outlet structure consisting of a 300 mm diameter Hicken bottom perforated riser with 50 millimetres diameter orifice plate and 150 millimetres diameter orifice plate at the higher elevation, to discharge via a 300 millimetres diameter outlet, pipe and a 2 metres wide overflow weir with 150 millimetres depth for emergency bypass. The outlet controls limit the maximum discharge to 20 litres per second under the 100-year storm event via the 300 millimetres diameter outlet pipe ; all flows to discharge into an existing wetland (EIS) located downstream along the west side of the property; including erosion/sedimentation control measures and all other appurtenances essential for the proper operation of the aforementioned Works.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

This proposal is for a new Environmental Compliance Approval (sewage) for the establishment of one stormwater management wetland works; in support of a proposed relocation and expansion of Kawartha Stair and Rail manufacturing and fabrication facilities; for the collection, transmission and disposal of stormwater run-off from a site located at 1665 Chemong Road, in the Township of Selwyn, County of Peterborough.

The proposed onsite sewage works will include a wetland facility, a wet pond, grassed swales and an underground infiltration facility; sized to provide quality and quantity control. The runoff will be conveyed via a ditch within the landscape area along the north side of the property into the wetland facility.
