The application for consent was draft approved on July 28, 2026 subject to conditions.

The application was reviewed for consistency with the environmental policies of the Provincial Planning Statement. One commenting letter was received via email. 

No specific concerns related to fish or wildlife habitat, species at risk, protected areas or public health and safety were identified in relation to this application. Given that the development is on existing developed lands, the small-scale of development itself, and mitigation measures there will be no negative impacts to greenspace, natural heritage and water quality and quantity, nor public health and safety.

Approval is subject to standard conditions related to finalization and additional conditions related to the mitigation of negative environmental impacts and consistency with the Provincial Planning Statement

Additional conditions that pertain to the protection of the environment include:

  • That prior to final approval, this Ministry is to be provided with written confirmation of adequate capacity to dispose of hauled sewage generated by the severed and retained lands. This written confirmation should take the form of a letter from the holder of an Environmental Compliance Approval (ECA) for an approved septage disposal facility, referencing the disposal facility and the related Ministry of the Environment, Conservation and Parks (MECP) approval, and confirming that the disposal facility has sufficient reserve capacity to accept hauled sewage from the proposed lots.
  • That prior to final approval, the Ministry must be provided with a letter from a waste disposal site confirming that it is operational and is willing to accept solid waste from both the proposed severed and retained lots.
  • That prior to final approval, and pursuant to subsections 53(12) and 51(25) and 51(26) or (27) of the Planning Act, the applicants shall enter into a Consent Agreement for the severed and retained parcels with the Ministry of Municipal Affairs and Housing (MMAH), to its satisfaction, addressing the potential development of the lands, including:
    • The parcels can only be used for resource-based recreational uses (including a recreational dwelling) and is not to be used for permanent residential, commercial or industrial uses; and
    • That the Consent Agreement will be registered on title.

The applicant has two years to satisfy conditions of draft approval, otherwise approval will lapse. The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before September 7, 2026.

Appeal Rights under the Planning Act

You can appeal all or part of this instrument to the appeal to the Ontario Land Tribunal (OLT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing. You have 20 days to begin the appeal process.

Who can appeal

Other than the applicant, only a "specified person" or "public body", as defined in s. 1(1) of the Planning Act, has the ability to appeal the decision to the Ontario Land Tribunal.

The proposed new lot will have approximately 31 metres of frontage, a depth of 285.00 metres and an area of 1.23 hectares. The proposed new lot contains a cabin and a shed serviced by a pit privy and lake water. The retained lot will have approximately 66 metres of frontage, 275.06 metres in depth and an area of 1.23 hectares. The retained lot also contains a cabin, a bunkhouse and a shed serviced by a pit privy and lake water.

The subject lands are located within unorganized territory in the District of Kenora, approximately 25km northwest of the boundary of the City of Kenora. The property is water access only via Sand Lake. 

The effect of creating this new lot would be to allow for existing uses being resource-based recreational use, to remain in place while having separate title to the properties, to allow for the properties to be transferred in the future.
