The Site is located at 113 Warren Road, Whitby, Ontario. Residential dwellings are scattered to the north east of the area beyond the CN rail line and a stormwater pond. A wetland is located to the south.  

The property is approximately 140 meters east of the intersection of Hopkins Road and Warren Road and approximately 1 km north of Highway 401. The property is zoned Restricted Industrial (M2) and permits a range of light industrial and commercial uses.

Simtor Environmental Ltd. operates a 1.8 hectare waste disposal site for the processing of solid non-hazardous waste materials limited to construction and demolition waste from industrial, commercial and institutional sources. This application was a waste multi-media file and included review information for three medias: waste, wastewater and air & noise. Three separate approvals have been issued for each media.

The facility currently receives unprocessed waste, from which recyclable material is separated, sorted and processed prior to being sent to market and residual materials are separated and sent to an approved site for final disposal. Recyclables and other reusable materials such as metal, concrete, brick, gravel, rubble, tires and other C&D materials are sorted and separated and sent to markets for further processing. Wood is separated and is further processed by shredding and chipping into wood chips indoors to be sent to a market to be used as bio fuel.

As part of this application, some changes were requested for the operation of the site including a new property line acoustical barrier, changes to stormwater management, truck volumes, equipment, waste tonnages and storage locations of materials including outdoor storage.

The ministry is committed to transparency and ongoing engagement with the public during its environmental decision-making process. The proposal for this project underwent public and agency consultation including a 45 days posting on the Environmental Registry. The 45 days comment period was August 9, 2018 to September 23, 2018. Comments were received by the ministry from the municipalities in the area

The review of this application included the involvement of three major stakeholders in Durham Region: including the Town of Whitby, the Regional Municipality of Durham Region and the Central Lake Ontario Conservation (CLOCA) as well as the York Durham District Office.

Due to the area of this facility, the applicant was also required to consult with the local Conservation Authority (CLOCA) and receive clearance letters for their proposal, prior to the ministry granting approval. This clearance was provided by CLOCA to the ministry as part of the approval of this Environmental Compliance Approval.

All concerns from the municipalities have been considered and addressed prior to the ministry granting approval.

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

Description of instrument

This proposal is to amend Environmental Compliance Approval (Waste Disposal Site) No. A680029 issued to Simtor Environmental Ltd. The processing facility is on a 1.8 hectare site and is located at 113 Warren Road, Whitby, Ontario.

The waste transferred/processed is solid non-hazardous industrial, commercial and institutional (IC&I) wastes and construction and demolition wastes (C&D) up to an annual maximum of 880 tonnes per day. The proposed amendment is to include the following:

  • the receipt and processing of an annual maximum of 880 tonnes per day (321,200 tonnes/year) of construction and demolition type waste from residential, C&D and IC&I sources
  • a maximum residual waste storage quantity of 500 tonnes at any one time
  • the transfer of residual waste from the facility shall not exceed 400 tonnes on any day
  • the residual waste and recyclable material from the facility shall be limited to 124,480 tonnes per year
  • maximum outdoor storage of 700 tonnes of unprocessed wood material in two storage piles (350 tonnes in each pile)
  • outdoor storage of metal in bins, brick, concrete, rubble, gravel pile, tires in a bin, paper, wood and cardboard in a bin, and mixed C&D material in a bin
  • a maximum total amount of unprocessed, processed and residual waste to be stored on-Site of 3,000 tonnes of waste at any given time

The facility serves the Province of Ontario and operating hours of 12:00 AM to 11:59 PM Monday to Sunday inclusive, 365 days per year.
