Decision on instrument
The Niagara Escarpment Plan Amendment (PH 180) and Development Permit (HE/08-09/326) were approved by the Joint Board on October 11, 2016. The Development Permit was issued on November 23, 2016 and is subject to a number of conditions relating to the quarry expansion.

There was extensive public consultation on the proposed Plan amendment and Development, the related Aggregate Resource Act licence process and the Planning Act process for the Official Plan and zoning by-law amendment, both formal (statutory public meetings) and informal, through the Joint Agency Review Team (JART) open houses and open houses hosted by the proponent. There were also one on one meetings with the citizen group POWER and public presentations before the Niagara Escarpment Commission, Halton Hills Council and Region of Halton Council.
All comments were documented and responded to in the final Joint Agency Review Team report and discussed in the final Niagara Escarpment Commission staff summary report regarding the plan amendment and development permit.
Members of the public and the citizen group also had the opportunity to give evidence before the Joint Board.

No Appeal exists on the Joint Board’s decision pertaining to this instrument.

Updates
The notice was updated on January 21, 2016 to advise the public that there has been no change to the status of this proposal and it is still being considered. No additional opportunity for comment is being provided for at this time.
Description of instrument
The lands subject to the Niagara Escarpment Plan Amendment PD 180 09 are designated Escarpment Rural Area by the NEP.
The proponent seeks to amend the NEP to change the designation of their property to Mineral Resource Extraction Area and Escarpment Natural Area. The proponent has also submitted a Development Permit Application for the proposed quarry expansion. An amendment is required because the NEP requires such an application for any new licensed quarry producing more than 20,000 tonnes annually. The proposal to designate certain lands to Escarpment Natural Area is based on the field work recognizing the natural heritage features on the property.
The proponent has also applied to amend the Region of Halton Official Plan, the Town of Halton Hills Official Plan and zoning bylaw under the Planning Act, and has applied for a Class A licence under the Aggregate Resources Act.

- the proposed amendment is being circulated to all landowners within 120 metres of the subject lands
- a newspaper notice will be published in the Acton Tanner, The Georgetown Independent and the Brampton Guardian inviting comment on the proposed amendment
- the proposed amendment will also be circulated to the Town of Halton Hills, the Region of Halton and other interested agencies for review and comment
- the Public Interest Advisory Committee established under the NEPDA will conduct a site visit of the property, report and provide advice on the proposed amendment
- the proponent has posted signs on the subject property to provide notice to the general public about the applications
- a Joint Agency Review Team has hosted a public information centre to inform the public about the application and will conduct a second public meeting to present its findings in addition to the statutory public meetings to be held under the Aggregate Resources Act and the Planning Act
