Aggregate Resources Act Licence No. 625428 was issued to St. Marys Cement Inc. (Canada) on December 1, 2021, subject to conditions specified on Schedule A (Prescribed Conditions) and B. The licensed area is 203.59 hectares in size and allows the operation of a pit below the water table. The tonnage condition specifies a maximum of 1,000,000 tonnes of aggregate may be removed from the site in any calendar year.

Three (3) comments were received in response to the Environmental Registry notice. Twenty (20) letters of objection were received in response to the Aggregate Resources Act (ARA) consultation process.
The concerns raised related to: traffic, noise and dust, health and safety concerns, impacts on groundwater, loss of agricultural land, loss of property values and impacts on the natural environment. The applicant worked to address the objections by providing additional information and revising the site plan.
There were eleven (11) unresolved objections at the end of the Aggregate Resources Act process. The application was referred to the Local Planning and Appeal Tribunal (now known as the Ontario Land Tribunal) for a decision. The Tribunal held a hearing on January 7, 2020 (Case No.: PL171093/MM180008) and directed the Minister to issue the licence.

Description of instrument
St. Marys Cement Inc. has applied for a Class “A”, Category 1 licence (Pit Below Water) to excavate aggregate from a pit of 203.6 hectares in size. This application is for a new pit. The annual tonnage condition applied for is 1,000,000 tonnes per calendar year.

The extraction area associated with the proposed application is 135 hectares.
Site plan information is available to view at the Guelph District Office. Making an appointment to view the information is recommended to ensure aggregate staff will be available to provide information and answer questions.

Comments received through Registry should not be construed as an objection under the Aggregate Resources Act in accordance with section 4.0 – Notification and Consultation Standards of the Provincial Standards 1.0 under the ARA. To be considered as a formal objector, individuals need to contact the MNR person specified on this notice to determine how to submit an objection.
Other public consultation opportunities
As specified in the Aggregate Resources Act, written notice concerning this application was delivered to landowners within 120 metres of the proposed licenced boundary; an information sign, giving notice to the public of this application was erected at the proposed site; and a Notice of Application appeared in the local paper, the Bradford Expositor on January 9, 2013. A public information session will be held on February 4, 2013 between 6:00pm and 8:00pm at the Burford Community Centre, 14 Potter St, Burford Ontario N0E 1A0.
The application for this proposal is being circulated within the MNR Guelph District office. Additionally, notification of this application will be forwarded to the Grand River Conservation Authority, the Ministry of the Environment, the Ministry of Agriculture and Rural Affairs and the County of Brant.
