Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

Updates

A second Notice of Intention to Revoke was issued to the licensee on December 10, 2019. The new Notice of Intention to Revoke contains reference to additional outstanding fees and reports including Compliance Assessment Reports, Production Reports and Licence fees owing from 2011-2018. No additional opportunity for comment is being provided at this time.

This notice was updated on January 27, 2016 and June 22, 2018 to advise the public that there has been no change to the status of this proposal and it is still being considered. No additional opportunity for comment is being provided for at this time.

 

Description of instrument

The Ministry of Natural Resources (MNR) under the Aggregate Resources Act (ARA) seeks to revoke Licence No. 3397 for the following reasons:

  1. contravention of section 15 of the Aggregate Resources Act which requires the licensee to operate the pit in accordance with this Act, the regulations, the site plan and the conditions of the licence. The non-compliance issues outlined in the Notice Suspension, dated May 17, 2012, have yet to be rectified.
  2. contravention of subsection 15.1(1)of the Aggregate Resources Act which requires the licensee, in accordance with the regulations, submit an annual report to the Minister for the purpose of assessing the licensee’s compliance with this Act, the regulations, the site plan and the conditions of the licence by September 30th annually. Compliance assessment reports are outstanding for 2011, and 2012.
  3. contravention of section 1 of Ontario Regulation 244/97 which requires the licensee to file with the Aggregate Resources Trust, on or before January 31st, an annual production report setting out the quantity of aggregate removed from the site in each month of the previous year. The Ontario Aggregate Resources Corporation advised MNR staff that the 2011 and 2012 production reports are outstanding.
  4. contravention of subsection 14(1) of the Aggregate Resources Act which requires the licensee to pay an annual licence fee in the prescribed amount within the prescribed time, and contravention of subsection 2(1) of Ontario Regulation 244/97 which also requires the licensee to pay an annual licence fee on or before March 15th annually. The Ontario Aggregate Resources Corporation advised MNR staff that the 2011 and 2012 licence fees are outstanding.

Ninety day Notices of Intention to Revoke were sent by registered mail to the licensee on September 6, 2013. The proposal to revoke will be null and void if the licensee achieves compliance with the above mentioned issues within the 90 day period specified in the Notice served on the licensee under s. 20(2) of the Aggregate Resources Act.

Should the licence be revoked, in accordance with subsection 20(4) of the Aggregate Resources Act, (non compliance with the Aggregate Resources Act, Provincial Standards, or site plan) the licensee would be entitled to an Ontario Municipal Board hearing provided he gives written notification to the Aurora District office within 30 days of receiving a Notice of Revocation.

Should the licence be revoked, in accordance with subsection 20(5) of the Aggregate Resources Act, (non payment of fees) the licensee would not be entitled to an Ontario Municipal Board hearing for that specific matter.

Other information

761368 Ontario Inc. currently operates this site under the authority of Licence #3397 under the Aggregate Resources Act. The licence was automatically suspended on October 1, 2011, for non-submission of the Compliance Assessment Report, and was formally suspended on May 17, 2012 for:

  1. failing to operate the licensed property in accordance with the approved site plan, as required under Section 15 of the Aggregate Resources Act R.S.O. 1990 Chapter A.8 as amended;
  2. failing to submit the 2011 Compliance Assessment Report, as required under Section 15.1 of the Aggregate Resources Act R.S.O. 1990 Chapter A.8 as amended;
  3. failing to submit the 2011 Production Report, as required under Section 1 of Ontario Regulation 244/97 as amended; and
  4. failing to submit the 2011 Annual Licence Fee, as required under Section 2(1) of Ontario Regulation 244/97 as amended.

The public may view a copy of the licence and site plan for this site at the MNR Aurora district office. Making an appointment to view the information is recommended to ensure aggregate staff will be available to provide information and answer questions.
