Requirements for public notification on the Environmental Bill of Rights registry do not apply where, in the minister’s opinion, the delay involved in giving notice to the public, in allowing time for public response to the notice, or in considering the response to the notice would result in:
- danger to the health or safety of any person;
- harm or serious risk of harm to the environment; or
- injury or damage or serious risk of injury or damage to any person.
The Director's Direction was issued as it was determined that a delay could result in harm or serious risk that untreated leachate from the pumping station may discharge to the environment.

Background
- On November 8, 2018, the ministry wrote a letter to Uniboard Canada Inc. (Uniboard) as the prior owner of the Mansteel Site, directing it to operate the leachate pumping stations and to maintain a freeboard of 30 cm in the leachate storage pond in order to stop the discharge of untreated leachate to the environment.
- On January 25, 2019, the ministry was advised by Uniboard that the level in the storage pond at Mansteel’s leachate collection facility was approaching 30 cm of freeboard and was rising at a rate of approximately 1.5 cm per day. Continued pumping to the pond could lead to over topping and discharge of leachate to the environment. If pumping leachate to the pond is stopped, this will lead to uncontrolled discharge at the facility's pumping stations and an uncontrolled discharge to the environment.
- On February 5, 2019, the City of Temiskaming Shores sent a memorandum to the ministry outlining its proposal to accept leachate originating at the Mansteel Site and requesting permission to receive the leachate at the New Liskeard Lagoon. The request also indicated that prior to 2012, the municipality accepted leachate from the same site.
Direction issued
Following a request from the City of Temiskaming Shores, on February 12, 2019, the Director provided emergency authorization to the municipality allowing them to accept leachate from the Mansteel leachate collection facility until June 21, 2019.
Specifically, the City was granted permission to direct leachate to an unused temporary storage lagoon, Cell F of the New Liskeard Lagoon, which is described in the City’s approval No. 9205-ANYPRW.
In granting the authorization, the Director also imposed additional operation and reporting requirements for the duration of the authorization.
