The ministry approved an amendment to Environmental Services Inc.'s Environmental Compliance Approval (Waste Disposal Site) No. A022108 to allow for the receipt of biosolids from sewage plants and to expand the service area.
The maximum waste receiving and waste storage on site will remain the same. The maximum rate of waste is 999 tonnes per day with a maximum total storage of:
- 443.7 cubic metres of industrial liquid waste
- 3,000 tonnes solid non-hazardous waste, sludge, contaminated soil, other spill clean-up waste and non-agricultural source material/biosolids
The facility's service area is Canada, USA and occasional international sources from internationally registered ships docking in the Great Lakes, and St. Lawrence Seaway system.

MECP has received 1 comment from the public on this proposed project. The concern is the increased traffic, smell and health concerns.
The biosolids is seasonal. At 36 tonnes per load there will be (in total) 14 truck loads in the fall and 14 truck loads in the spring. The net result is that there are 2 or 3 days in the fall and spring when traffic at the site requires 4 or 5 extra round trips per day.
The biosolids will be stored on an asphalt pad and covered with a tarp as soon as the pile is built to prevent rainwater from entering the pile. The asphalt pad is equipped with a water collection system. All water from the pad is captured and treated on site or shipped from site to an approved sewage treatment plant. The proponent has in place surface water and ground water monitoring programs that are reported to MECP annually. The monitoring programs will indicate our compliance with the associated water quality requirements.
If at any time odours are generated at the Site, resulting in complaints received by the Ministry and validated by a Provincial Officer, the company shall upon request of the Ministry, take appropriate remedial action immediately.

Appeal process for decisions published before June 1, 2021

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

Description of instrument
This proposal is for an amendment to Environmental Compliance Approval (Waste Disposal Site) No. A022108 issued to Environmental Services Inc. for the use and operation of a waste disposal site with a total site area of 4.50 hectares at 22153 King and Whittle Road, Tilbury, Chatham-Kent, Ontario.
The site is used for transfer and processing of solid non-hazardous waste. Approval is sought for the inclusion of NASM. The maximum rate of waste is 999 tonnes per day with a maximum total storage of 443.7 cubic metres of industrial liquid waste and 3,000 tonnes solid non-hazardous waste, sludge, contaminated soil, other spill clean-up waste and NASM. The facility's service area is Canada, USA and occasional international sources from internationally registered ships docking in the Great Lakes, and St. Lawrence Seaway system. The hours of operation is 24 hours a day, 7 days a week.
