A new Environmental Compliance Approval has been issued which will permit the operation of a waste transfer and processing facility for a broad range of hazardous and liquid industrial wastes. The facility will be used to temporarily store and bulk these wastes in 3 above ground storage tanks and in 3 trailers.

The above ground storage tanks will be steel tanks that are constructed with double walls for protection against leaks to the environment. The space between the double walls will be monitored for early detection of leaks from the interior walls and the tanks will be located with another containment area.

The trailers will be equipped with internal spill trays and are also located within a separate containment area.

Unloading and loading of wastes from trucks into storage will be conducted within containment to prevent the release of liquid wastes.

The following is a summary of the conditions that have been imposed:

  • the types and amounts of waste that can be stored are specified in conditions
  • inspection and maintenance of spill prevention measures (including secondary containment features) are specified in conditions
  • all storage vessels must be clearly identify the types of wastes stored within them
  • a requirement to install 3 groundwater wells and to sample and monitor groundwater annually for contaminants has been in a conditions
  • an annual monitoring report is required to be submitted to the ministry

As part of the ministry's approvals process, the applicant provided adjacent neighbours with written notification of the proposal and the opportunity to provide comments. One comment was received which expressed the following concerns. The ministry's explanation of how these were taken into consideration follow each comment.

Impact of 24 Hour Operations

  • The ministry has clarified with GFL that the facility will not normally operation 24 hours per day/7 days per week. The normal operating hours of the facility will be Monday - Friday (7:00 am to 5:00 pm) and Saturdays (7:00 am to 3:00 pm). Operations outside of these hours will be limited to when the facility is responding to and managing spills for clients. A condition clarifying the hours of operation has bee imposed in the approval

Potential for impact on groundwater and surface water near the facility.

  • The groundwater and surface water at and near the facility is protected by requiring all storage of waste to be done in secured storage vessels that have secondary containment to control any leaks or discharges. In particular:
    • above ground storage tanks are constructed with double walls. The interstitial space between the two walls will be monitored to detect any leaks through the primary wall of the tank
    • Tanks are equipped with overllow protection
    • Storage trailers will have their own spill trays within the trailers
    • All tanks and trailers are stored within dedicated areas with additional secondary containment consisting of paved areas with curbs
    • All loading and unloading procedures will be done with their own containment
    • Three groundwater wells will be installed on the Site and sampled prior to the facility being operational and after that on an annual basis. The wells will be analyzed for a range of contaminants that are potentially managed at the Site

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

This proposal is for a new Environmental Compliance Approval for GFL Environmental Inc. for the use and operation of a waste disposal site (transfer/processing) located at 374 Crawford Street in South Porcupine, Ontario.

The function of the waste disposal site is to:

  • receive, process (mix, consolidate and solidify) and transfer non-hazardous solid and sludge waste materials
  • receive, consolidate and transfer liquid industrial wastes
  • receive, temporarily store and transfer hazardous and non-hazardous wastes (not more than 90 days) to other Ministry of the Environment, Conservation and Parks approved recycling/disposal facilities

Wastes will be collected from GFL’s industrial and commercial clients within the Provinces of Ontario and Quebec.

The hours of operation for the site are proposed for 24 hours per day, 7 days per week.
