We issued an approval to GFL Environmental Inc. to increase storage, add a solidification operation and update existing processes activities at their 96 Middleton Street, Brantford location.
As part of this amendment waste storage capacity was increased by adding three 10,000 litres storage tanks, the outdoor drum storage area was expanded to 500 drums, and temporary storage of soild non-hazardous waste including soil and industrial waste was added. A new mixing and solidification process has also been added, and a new oil filter crushing unit was approved for installation.

Start the process to appeal
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application
You’ll need to mail your application that you prepared in step #1 to each of these three parties:

This proposal is for an amendment to Environmental Compliance Approval (Waste Disposal, Transfer and Processing Site) No. A650074 for GFL Environmental Inc., for the use and operation of a waste disposal site at 96 Middleton Street, City of Brantford, County of Brant, Ontario. It has a total area of 0.62 hectares, to be used for storage, transfer and processing of solid industrial waste, liquid industrial waste, hazardous solid waste, and hazardous liquid waste.
The proposed amendment includes:
- addition of three (3) 100,000 liter storage tanks
- a mixing and solidification pad that will add approximately 35,000 liters of storage capacity, an expansion of the current exterior concrete slab-on-grade
- instillation of a new oil-filter crusher
- removal of requirements limiting specific waste classes to a percentage of the total quantity of the waste managed
- an increase in the maximum storage limit for waste and virgin product to 500 drums or equivalent of 102,500 liters to be stored in the outdoor container area
- addition of temporary storage and bulking of solid non-hazardous waste, contaminated soils and reactive wastes from industrial and commercial sources
- changes to ongoing study and reporting requirements
- changes to allow the shipment of residual waste off-site
- expansion of the service area of the site from Ontario to North America
The site is able to operate up to twenty-four (24) hours a day, seven (7) days a week, 365 days a year, and will service North America.
