Three Certificates of Property Use were issued to Ray of Hope Inc. for the properties located at 851 King Street East, 432 Charles Street East and 5 Stirling Avenue South in the City of Kitchener.

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1694 for public comment from April 23, 2020 to June 7, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision details

Certificates of Property Use (CPUs) were issued to Ray of Hope Inc. on June 10, 2020 as follows:

  • 851 King St. E., Kitchener - CPU No. 7882-BM5LHV01
  • 432 Charles St. E., Kitchener - CPU No. 7882-BM5LHV02
  • 5 Stirling Ave. S., Kitchener - CPU No. 7882-BM5LHV03

Each CPU requires the instrument holder to ensure that several risk management measures (RMMs) are undertaken for the intended mixed commercial, community, residential and/or institutional use of the properties as summarized below.

851 King Street East, Kitchener - CPU No. 7882-BM5LHV01

For this CPU, the key RMMs for the Property include, but not limited to, the following:

  • installing, inspecting and maintaining any new hard cap, fill cap and or shallow soil cap barriers on the areas of the property as identified in Schedule ‘A’: Figure 2 and as per Section 4.2 (a) and 4.2 (e) of the CPU
  • prohibiting the construction of any building (s) on the property unless the new building (s) is constructed as specified in Section 4.2 (f) of the CPU
  • implementing a soil and groundwater management plan during any intrusive activities undertaken on the property potentially in contact with contaminants of concern (COCs) in soil and groundwater as per Section 4.2 (p) of the CPU
  • implementing a health and safety plan during any intrusive activities undertaken on the property potentially in contact with COCs in soil and groundwater that have been identified in the risk assessments (RAs) as specified in Section 4.2 (q) of the CPU
  • prohibiting the planting of fruit and vegetables for consumption, other than those planted in above ground containers such that they are isolated from the subsurface conditions as per Section 4.2 (r) of the CPU
  • prohibiting the use of groundwater in on or under the property as per Section 4.3 of the CPU
  • registering a certificate on the property title in accordance with Section 197 of the Environmental Protection Act and that before dealing with the property in any way, a copy of the CPU is to be given to any person who will acquire an interest in the property as per Sections 4.6, 4.7 and 4.8 of the CPU.

432 Charles Street East, Kitchener - CPU No. 7882-BM5LHV02

For this CPU, the key RMMs for the property include, but not limited to, the following:

  • installing, inspecting and maintaining any new hard cap, fill cap and or shallow soil cap barriers on the areas of the property as identified in Schedule ‘A’. Figure 2 and as per Section 4.2 (a) and 4.2 (e) of the CPU

5 Stirling Avenue South, Kitchener - CPU No. 7882-BM5LHV01

For this CPU, the key for the property include, but not limited to, the following:

  • installing, inspecting and maintaining any new hard cap, fill cap and or shallow soil cap barriers on the areas of the property as identified in Schedule ‘A’: Figure 2 and as per Section 4.2 (a) and 4.2 (e) of the CPU

No comments were received as a result of the consultation process and no changes were made by the director prior to finalizing the CPU.

Appeal Information

Appeals are not allowed. This instrument type cannot be appealed. Third parties are not able to apply for leave to appeal in respect of proposals which are posted while Ontario Regulation 115/20 is in effect.
