The ministry has amended Environmental Compliance Approval No. A031806 No. A220106 on April 22, 2020 for Clean Harbors Canada Inc. to allow temporary storage and transfer of biomedical waste, limited to waste materials generated from decontamination activities, at approved waste disposal sites in the Township of St. Clair and City of Mississauga.

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020. However, we are posting this bulletin because the decision was an urgent, COVID-19-related decision, and was made April 22, 2020 while Ontario Regulation 115/20 was in effect. There was no consultation period for this notice.

Environmental protections continue to be a vital consideration in all government decision-making. We are committed to continuing public transparency and have posted this bulletin to inform the public about our decisions during this unprecedented emergency period.

Ontario recognizes the impacts the COVID-19 outbreak has had on the regulated community and is taking necessary steps to protect the health and well-being of all Ontarians while ensuring continuity of important operations.

While environmental protection remains a priority, we recognize that in some cases temporary relief from certain regulatory deadlines and other requirements may be needed for some operations due to staff shortages or to support physical distancing.

At this time, the Ministry of the Environment, Conservation and Parks is providing flexibility on a case-by-case basis to waste management facilities to allow them to operate for longer hours or accept new types of waste.

Temporary relief measures have only been granted where the ministry is satisfied that protections for public health and the environment are maintained. These steps are temporary in nature and will only be taken during this unprecedented emergency period.

We are all working together to combat this outbreak and hope that normal business operations will resume as soon as possible.

To ensure public transparency on ministry decision making during this time, we will continue to post bulletin notices on the Environmental Registry with details on the relief provided until normal business operations resume.

Decision details:

On April 22, 2020, we granted temporary approval to Clean Harbors Canada, Inc. to receive, store and transfer biomedical waste generated while providing COVID-19 decontamination services.

Within 90 days of the end of the emergency order, the company will return both sites to normal operations. This will give them time to properly ship the remaining biomedical waste that is generated and stored at the site.
