Pourquoi une consultation n’est pas nécessaire
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.
Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on April 6, 2020 while Ontario Regulation 115/20 was in effect.
Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1603 for public comment from April 6, 2020 to May 21, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision details
We have granted an amendment to Environmental Compliance Approval No. 5021-AEUGUJ for TACC Construction Ltd. for the operation of a mobile concrete crushing unit, operating in various locations in the Province of Ontario.
The process crushes reclaimed concrete, gravel and excavated rock from construction and demolition sites into material of a specified size to form reusable construction materials or dry aggregate for new concrete.
This amendment includes additional equipment used in the mobile crushing process, including an impact crusher, screening plant, and conveyor stackers.
Contaminant emissions to the atmosphere include particulates, silica, and nitrogen oxides.

Effect of consultation
The comment was reviewed and considered in the ministry’s decision whether or not to proceed with this proposal. The comment expressed concerns about the distance between the proposed operation and members of the public.
Ministry’s Response: The application has demonstrated that the operation of the facility complies with the ministry’s applicable air and noise requirements including but not limited to the air discharge requirements in Reg.419/05: Local Air Quality Regulation.The approval includes minimum separation distances from air and noise receptors.
Third parties are not able to apply for leave to appeal in respect of proposals which were posted while Ontario Regulation 115/20 was in effect between April 1, 2020 and June 14, 2020. Ontario Regulation 115/20 exempted all proposals for instruments from posting requirements under the EBR. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
