Pourquoi une consultation n’est pas nécessaire
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.
Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1701 for public comment from April 27 – May 27, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

On September 24, 2020 the ministry issued an exploration permit near Shuniah to undertake exploration activities.
This permit will allow the company to conduct:
- mechanized stripping (greater than 100 square metres in a 200 metres radius)
- pitting and trenching of bedrock (greater than 3 cubic metres in a 200-metre radius)

Effects of consultation:
No comment was received through the Environmental Registry of Ontario resulting in no impact on the decision to proceed or not with this proposal.
Third parties are not able to apply for leave to appeal in respect of proposals which are posted while Ontario Regulation 115/20 is in effect.
